Dear Questioner,
Thanks for your inquiry!
Regarding the above, we would like to inform you that, according to UAE law, a divorce can be filed in the UAE if one or both parties are residents of the country.
Therefore, your husband cannot force you to move to France in order to avoid the divorce proceedings in the UAE.
Additionally, as a mother, you have the right to decide where your children will reside and attend school. Your husband cannot force you to move to France with the children without your consent.
However, it is important to note that if your husband files for divorce in France, the French court may have jurisdiction over the case and may require you to attend the proceedings in France.
In this case, you may need to seek legal advice from a lawyer in France.

Greetings,
Thank you for reaching out with your question regarding your situation!
Filing for divorce in the UAE while your husband is in France raises several important legal considerations, especially concerning the residency status of both parties and the best interests of your children.
In the UAE, you can file for divorce if either spouse resides here, which seems applicable in your case given that your husband legally resides in the UAE and owns a business here.
Your husband's current location in France does not preclude you from filing for divorce in the UAE.
Regarding your concern about being forced to move to France, the UAE courts typically prioritize the welfare of the children and the residency status of the parents.
If you can demonstrate that your husband is a UAE resident, owns a business, and has significant ties here, this can strengthen your position to keep the children in the UAE, especially considering their schooling and established life here.
Given the complexities involved in divorce and custody cases, I recommend discussing your case in more detail to provide tailored legal advice and representation to ensure your rights and interests, as well as those of your children, are protected.

Dear Questioner,
In general, a person cannot force their spouse to move to another country against their will, especially in cases of divorce where custody and living arrangements for children are involved.
However, the specific laws and regulations pertaining to divorce and custody may vary depending on the country in which the divorce is being filed.
In the UAE, the custody of children is typically governed by Islamic law, which may differ from French law. It would be advisable to consult with us as a legal expert in UAE family law to understand your rights and obligations in this situation.
Additionally, it may be helpful to gather evidence of your husband's residency and business interests in the UAE to support your case for filing for divorce in the UAE.
