The procedure of judgement execution in a labour case

Hi,

Last September I filed a case against my employer as he hasn’t given any of my settlement after my 2 years of service in their company.

However, last November 2018 the court ruled in my favour, and up to date, I haven’t received any call from my previous company.

Yet, I’m trying to file for execution but this typing centre keeps telling me to come back after a week which is illogical for me because it’s been 2 months since I received the court decision.

By this time, I should've already received the settlement.

What advice can you share with me to make the process faster as I’m planning to return to my home country?

Dear Questioner,

Trust you are doing fine.

Further to your enquiry, please be informed that after the judgement is issued from the first instance court, the opponent has 30 days to file an appeal.

If there is no appeal filed by the opponent, you can file for execution. If the judgement was made in the absence of the opponent, then in such case, you have to notify the opponent first.

The procedure of notifying the opponent can be lengthy if there is no right address available. The time period of 30 days starts once the opponent is notified of the judgement.

After the judgement becomes final, an application can be made for execution. Procedure for execution is divided into 3 stages:

1. Registration & payment of the fee

2. Notification to opponent

3. After receiving the notification, 15 days waiting period. After the expiry of the 15 days, the judgement can be executed.

Since we are not aware of the current stage of the case, we request you to provide us please with your judgement copy for us to review and to opine you more accurately.
