Can I renew my lease despite the agency adding an eviction clause without my consent?

Hi,

The real estate agency that leased me the apartment included: "Tenant confirmed that they will vacate the property after the end of the contract" under additional terms in my Ejari without consulting me.

They wanted me to vacate last year or increase the rent way above the RERA recommended increase.

Can I renew my tenancy contract as per RERA guidelines this year?

I haven't received any DLD or other notice from my landlord.

Hello,

You have the right to renew the tenancy contract according to RERA regulations. The clause they added stating you'll vacate is irrelevant without your consent.

Since you haven't received a proper non-renewal notice, you can initiate the renewal process. Review your contract for the expiry date and contact the agency about renewing under RERA guidelines.

Use the Rental Index to determine the allowable rent increase and negotiate within those limits. If they object, you can file a complaint with the RDC.

For further clarification, please share your WhatsApp number.

Dear Questioner,

Thanks for your inquiry!

Regarding the above, we would like to inform you that, according to UAE law, a landlord cannot force a tenant to vacate the property at the end of the contract without a valid reason.

The landlord must give the tenant a notice of eviction at least 12 months before the end of the contract, and the reason for eviction must be stated in the notice.

In your case, it seems that the real estate agency has included this clause in your Ejari without your consent, which is not legally binding.

You have the right to renew your tenancy contract as per RERA guidelines, and the landlord cannot increase the rent above the RERA-recommended increase without a valid reason.

If you have not received any notice from your landlord, you can renew your tenancy contract as per RERA guidelines.

You can also consult with us as a legal advisor or contact the Dubai Land Department for further clarification on your rights as a tenant.

It is important to note that any changes to the tenancy contract must be agreed upon by both parties and cannot be imposed unilaterally by the landlord or real estate agency.

Kindly do not hesitate to contact us at [-------] for further guidance.

Greetings,

Yes, the rent increase should be as RERA valuations.

It is important to note that any terms added to your Ejari agreement without your consultation or agreement may not be legally enforceable.

If the real estate agency has added a clause stating that you will vacate the property after the end of the contract without your approval, you may have grounds to dispute this term.

According to RERA guidelines, rent increases for renewals are capped at a maximum of 5% of the current rent amount.

If the landlord is attempting to increase the rent above this limit, you have the right to challenge the increase and renew your tenancy contract in accordance with RERA guidelines.

It is recommended to communicate with your landlord directly and express your concerns about the added term in your Ejari agreement.

You may also seek legal advice or contact the Dubai Land Department (DLD) for assistance in resolving any disputes regarding your tenancy contract.

Remember to always review and understand the terms of your agreement before signing any documents.

Dear Questioner,

You must adhere to the terms of the contract, and we advise you to negotiate with the landlord to renew the rent at the price specified by RERA.

Hello,

If you do not receive any notifications from the landlord of an increase in the rent or a refusal to renew within the legal period, the contract will be automatically renewed at the same current rental value.
