Questions & Answers
Who notifies the defendant in Dubai online court cases: me or the court?
Hello,
I just wanted to know how the Dubai court system works.
Once I file a case online, do I have to issue the notice, or does the court notify the defendant on its own?
Dear Questioner,
In Dubai, the court system is based on the UAE's civil law system and operates in Arabic. When you file a case online, the court will typically notify the defendant on your behalf.
The court will serve a copy of the filed case to the defendant through an official process server or other means of communication.
However, if the defendant's address is not known, or if they are overseas, you may be required to provide the necessary information and assistance to ensure proper notification.
It is important to note that each case is unique and may require specific steps to notify the defendant.
It is always advisable to consult with a legal professional or the court's service center for guidance on the notification process in your particular case.
Once you submit the claim and any necessary fees, the Dubai Courts will take over the notification process. Their court bailiff's office will handle serving the claim to the defendant.
After receiving the notification, the defendant has a specific timeframe to respond to the claim, usually within 30 days.
This response could involve acknowledging the claim, contesting it, or proposing a settlement.
If you need further clarification, feel free to ask.
