After securing an executive judgment for unpaid salary and final settlement, what's next?

Dear Sir/Madam,

I hope this message finds you well. I am writing to follow up on the matter of my unpaid salary and final settlement, amounting to 49,000, for which I have already obtained an executive judgment.

Despite this, I have not yet received the payment.

Could you please advise on the next steps to proceed with the issuance of an arrest warrant or any other necessary actions to ensure the recovery of my dues?

Dear Client,

To recover your unpaid salary and final settlement of AED 49,000, for which you have an executive judgment, you should open an execution file with the court that issued the judgment.

If the debtor fails to comply, request the court to issue an arrest warrant and take additional measures such as freezing bank accounts or seizing assets.

For detailed legal advice and assistance, please contact us at [-----] to address the debt promptly to mitigate any travel restrictions or legal consequences.

Dear Questioner,

Thanks for your inquiry!

Regarding the above, we would like to inform you that, according to UAE law, if an employer fails to pay an employee's salary or end-of-service benefits, the employee can file a complaint with the Ministry of Human Resources and Emiratization (MOHRE).

The MOHRE will then investigate the matter and try to resolve it through mediation between the employer and employee.

If the mediation is unsuccessful, the MOHRE will issue a report stating the amount owed to the employee. The employee can then take this report to the court and request an execution order to enforce the payment of their dues.

In your case, since you have already obtained an executive judgment, you can take this judgment to the court and request an execution order.

The court will then issue a notice to the employer to pay the outstanding amount within a specific timeframe.

If the employer fails to comply, the court may issue an arrest warrant against the employer.

However, it is important to note that the issuance of an arrest warrant is not a guaranteed solution and may not always result in the recovery of your dues.

It is advisable to seek legal advice from a lawyer who specializes in labor law to guide you through the process and ensure that your rights are protected.

Additionally, you can also file a complaint with the MOHRE's Wage Protection System (WPS) if your employer has not been paying your salary on time.

The WPS is a system that ensures timely payment of salaries to employees in the private sector.

Kindly do not hesitate to contact us at [------] for further guidance.

I understand your situation regarding the unpaid salary and final settlement. It's essential to follow up through legal channels to enforce the judgment and ensure you receive your dues.

In cases of non-payment, you can work with a legal professional to take steps like seeking an enforcement order, which could lead to actions such as seizing assets, garnishing wages, or obtaining a court order to enforce payment.

Additionally, you may consider requesting an arrest warrant as a last resort if all other methods fail.

It's crucial to contact a legal expert to guide you through the process and ensure that your rights are protected during the enforcement of the judgment.
