Moved into a new apartment with incomplete maintenance and Tawtheeq. What to do?

Hello,

We recently moved into a new apartment on the first of this month. Upon arrival, we discovered that maintenance had not been completed, and the Tawtheeq had not been changed to our name.

When we inquired with the agent, they explained that the previous tenant's contract did not end until the 8th of this month, and they had not terminated the contract.

As a result, we are currently without power, water, and unable to register for AC. We are concerned about potential liability, as it seems we may have moved in illegally before the previous tenant's contract ended.

What should we do in this situation, and are we liable for anything regarding our move-in? Our contract states it begins on the 31st of May, and we have paid all fees to the agent and owner.

Greetings,

The landlord must adjust your situation. This matter is beyond tolerance.

You must contact him first to reach an amicable solution before resorting to litigation and demanding compensation. Or you can submit a legal warning to him.

Dear Questioner,

You will be entitled to make payments from the date you have used the apartment. Further, you can file a case if they ask you to pay the dues of the previous tenants.

With regard to the maintenance, we need to check your tenancy contract.

Please contact me at [------] for detailed discussion and assistance.

Hello,

Despite your lease starting on the 31st and fulfilling your obligations, contact the landlord immediately and remind them of the breach of contract.

You are not liable for the previous tenant's overstay. You can file a complaint with the RDC as you have a valid lease.

If you need further clarification, please share your WhatsApp number.

Dear Questioner,

Write to the landlord and agent, demanding immediate maintenance, power, and water restoration, as your contract started on May 31st and all fees have been paid.

You are not liable for moving in despite the previous tenant's contract ending on June 8th, as your lease legally began on May 31st.

We can have a quick call to discuss further. I am available on [-------].

Dear Questioner,

I'm sorry to hear about the challenges you are facing with your new apartment move-in. It's important to address the issues promptly to ensure your living situation is properly established and compliant with the required procedures.

Here are some steps you can consider taking in this situation:

1. Document the Situation:

Keep a record of all communication with the agent, owner, and any relevant parties regarding the maintenance issues, Tawtheeq transfer, and utility services.

2. Contact the Landlord or Owner:

Reach out to the landlord or owner of the apartment to inform them about the maintenance issues and the discrepancies in the Tawtheeq transfer. Request their assistance in resolving these matters promptly.

3. Follow Up with the Agent:

Continue to communicate with the real estate agent who facilitated the rental to ensure they are taking the necessary steps to address the maintenance and administrative issues.

4. Seek Legal Advice:

If the situation is not resolved satisfactorily or if you have concerns about potential liabilities, consider consulting with a legal advisor specializing in real estate matters to understand your rights and obligations as a tenant.

5. Temporary Accommodations:

If the lack of basic services such as power, water, and AC persists, you may need to arrange for temporary accommodations until the issues are resolved in your new apartment.

6. Stay in Communication:

Stay in regular communication with all concerned parties to track the progress of resolving the maintenance and administrative issues affecting your move-in.

According to the information you provided, you have fulfilled your obligations as stated in your contract, and the responsibility for ensuring the apartment is ready for occupancy rests with the landlord or owner.

It's important to assert your rights as a tenant and seek a satisfactory resolution to the current challenges you are facing.

If needed, involving legal counsel can provide you with guidance on the best course of action to take.
