Q: We moved into a villa in August 2017 and we paid one cash cheque payment to the owner who is local, as he gave us a copy of his Emirates ID and contract.
In December, our water was cut and was told by ADDC that the water has not been paid since August, which we all donated and paid for as we are about 7 tenants in the villa (Studio).
On the 10th of this month, a legal notice came from the court showing First Gulf Properties that the landlord should appear in the court. He didn't show up to which.
Yesterday, another same one was sent to him to appear today of which I doubt he did go because all his numbers are off. I need to know what's my right in this.
NB: This property is in Abu Dhabi and I have a copy of the landlord's Emirates ID. I even took a picture of him and my husband with the agent, and a copy of the cheque I gave to him the day we signed the contract.
Please advise me.
Thank you very much as I wait for your swift advice.

Reimbursement of rent payments from the landlord for breach
1
Q: Hello Mrs Khan
I have a situation here, I have to take a flat on rent and the rent was agreed to be paid in 6 Instalments. So I made the first instalment in cash and rest with post-dated cheques along with a security deposit cheque.
Now, the situation has arisen that the landlord has not signed the contract because of some court case on the building and I have not the received the flat as promised.
Can I cancel my cheques with expecting any actions to be taken against me as I have not received the flat as agreed, and should I lodge a police complaint? Is there any other action that needs to be taken?
Thanks
Anuj

Can the landlord breach the tenancy contract if I refuse a rent increase above RERA Index?

2
Q: My landlord said he wants to increase the rent and I cited that the RERA Index does not allow them to do that.
He came back saying we can proceed through a rental committee to get a rental valuation, and if we choose not to, then he will:
(1) have one cheque instead of our original 3 cheques
(2) have me pay for the chiller though in the contract it says it's the landlord's responsibility.
Can he do that?

I have Form F for apartment which caught fire and the broker refused to return the deposit. What to do? 0
Hello
I have Form F for an apartment in [----], which caught a huge fire recently.
There is no force majeure clause in the contract, but according to the law in the UAE, it shall be terminated without penalty.
The seller doesn’t want to cancel the contract F, and the broker of seller is not refunding the deposit.

I posted a review for a piercing shop, and they threatened me to file a defamation case against me. What to do? 0
I recently posted a review for a piercing shop, and they threatened to file a defamation case against me. I didn't get it first. Their customer service was rude, and when I posted a review about it, they said they would file a complaint.
I basically said I gave them one star, and I said whenever I have gone to their Instagram page to ask questions, they have been rude to me.
Probably they don't want to answer or they are irritated by my questions for improving their customer service, especially for their clients who paid you for piercings!
This is my review. I want to ask, is this illegal and considered defamation?
Don't I have a right to post reviews?

Are there any risks of losing my labor dues if I sign the cancellation form before receiving them? 0
Good afternoon,
I have noticed the following clause in the cancellation form and would like to ask whether it could potentially affect the complaint file in the future:
I certify that I have received all my dues up to date.

Can my employer refuse to give me even one day off as a nanny in the UAE? 0
Hello,
I am a nanny of 1-and-a-half-year-old twins.
I asked my employer to have a day off, even once a month, but she didn’t allow me! I messaged her on WhatsApp, but she didn’t reply.
Last month, I talked to her husband to ask for a day off again. He told me that he would arrange it. Then I messaged him yesterday to have a day off on Monday, July 7, 2025, but he never saw my message.
What should I do?

Is it legally acceptable to give birth in the UAE if the mother is single? 0
Hello,
Is it okay to give birth in the UAE if the mother is single and the father is married?
Will there be any problem with that, as long as the parents declare that they are the biological parents to obtain the child's birth certificate?

If acquitted by the appeal court, is the travel ban and wanted status automatically removed? 0
Hello,
If acquitted by the appeal court, is the travel ban and wanted status automatically removed? I mean, an innocent verdict was issued by the first instance court, then it was appealed, and after that, the travel ban was there.
Now, the appeal court has issued an acquittal from all charges; so is the travel ban still there, or is it automatically removed after the judgment is issued?

How to get legal help with drafting a memo for a family case in cassation? 0
I need help drafting a cassation memo for submission to the Abu Dhabi Court in a family case. I already have all the documents.
Since there's no hearing at this stage, I don’t need full legal representation—just memo drafting. My ex-wife is claiming 2024–25 school fees, though child support is already granted.
First instance rejected her claim, but the appeal overturned it and ordered me to pay 16,000 AED.
I want to file a cassation due to legal errors and flawed reasoning in the appeal judgment. My budget is limited.

How long does it take for a bounced cheque case to be closed after a settlement? 0
Hello,
I had a cheque bounce case filed against me in Dubai, but I’ve now settled it with the complainant. The case has been with the Public Prosecution, and I’ve already submitted the notarized settlement documents.
It’s been 5 days since submission, and when I checked with the legal team, they couldn’t give me a clear timeline on how long it might take for the case to be withdrawn and for me to receive clearance.
Does anyone here have experience with this process? How long did it take for your case to be closed after submitting the notarized withdrawal request? Should I expect it to be done in a few days, or could it take longer?
Thanks in advance!

Am I liable for the previous owner’s unpaid service charges when buying a Dubai property? 0
Hello,
I am purchasing an apartment in Dubai from a seller who originally bought this flat at an auction. There were outstanding service charges from the building management company prior to the auction.
That pending amount was never updated on the Mollak system as a write-off, and until now, it appears as outstanding on the statement of account.
When I buy this apartment, an NOC is being issued stating that there are no dues from the owner, and based on that, I intend to finalize the deal. I would like to know if, in the future, I may be asked to clear these pending service charges by the owners' association.
The building management company is trying to clear the outstanding amount with Mollak, but it seems it’s taking a lot of time. What should I do?

How can victims file a group case for fraud, bounced cheques, and misuse of credit cards? 0
Hello,
I would like to ask for legal advice regarding a fraud case in Abu Dhabi involving multiple victims. The suspect issued bounced cheques, received AED with a promise to exchange it into IDR but failed to deliver, misused other people’s credit cards, and operated an unlicensed travel/tour business.
Many clients paid for Umrah or vacation packages that never happened. The total loss is significant, and many victims have evidence such as WhatsApp chats, bank transfers, and bounced cheques.
We believe this involves a breach of trust and embezzlement. We would like to know if we can file a group case, what legal steps to take, and the cost of legal representation.
Thank you!

Is it obligatory to issue an invoice for my customer to process his down payment? 0
Hello sir,
Is it obligatory to issue an invoice for my customer to process his down payment?
Our system doesn't allow us to issue an invoice unless the goods exist in our inventory. We also require this advance or down payment as confirmation of his order.
My customer is insisting on issuing him an invoice and says that this is required by UAE laws.
