Landlord's breach regarding water supply and finding buyers for farm's yield. What to do?
Dear Sir/Madam,
I rented a farm in Umm Al Quwain, and the landlord agreed to provide free water, supplying 50m³/day during winter and up to 120m³ for the rest of the year.
He also agreed to assist in finding buyers for the yield and fresh alfalfa for camels and cattle. However, he doesn't want to supply the water and about helping find buyers, he says "This is not my job."
Of course, guarantee checks are given and now I refuse to pay since he doesn't fulfill his obligations. I tried to communicate but the sole reply I get now is: "I don't care about the agreement and I am very powerful."
Of course, the check is handed over to the bank and since I emptied the account, it will bounce. I am faced with two conflicting replies that contradict my business etiquette.
What steps should I take next?
Dear Questioner,
Thank you for reaching out to me with regard to the dispute surrounding your farm rental agreement in Umm Al Quwain.
I understand the frustration and challenges you are facing due to the landlord's failure to fulfill their obligations as outlined in the agreement.
Based on the information you've provided, it appears that the landlord has breached several key provisions of the contract, including the provision of free water and assistance in finding buyers for the yield.
Their disregard for the terms of the agreement is unacceptable and puts your business operations at risk.
In such situations, it is important to address the matter through legal channels to seek a resolution. My recommendation would be to initiate legal proceedings to enforce the terms of the contract and seek compensation for any damages incurred as a result of the landlord's breach.
I understand that this may seem daunting, especially considering the landlord's assertion of power. However, it is essential to assert your rights and protect your interests in this matter.
As your legal representative, I am fully prepared to assist you throughout the process and ensure that your rights are upheld.
Please feel free to contact me at your earliest convenience via WhatsApp or phone to discuss the specifics of your situation further and to explore the best course of action moving forward.
Dear Questioner,
We can send him a strong legal notice for breaching the contract.
Please contact our senior legal consultant Mr. Muhammad Abdullah for further details.
Dear Questioner,
First of all, we are happy to answer your inquiry.
First, you must review the lease contract concluded between you and the obligations of the contracting parties to clarify who violated the terms of the contract and who was harmed, and to clarify your legal position.
As for guarantee checks, it is permissible to respond to them legally and prove their guarantee in order to strengthen your legal position and take legal action before issuing or taking any legal action against you.
Thanks!
