Can my company file a case against me if I resign after five years of service?

We have a limited contract and my contract has just been renewed.

I have been with the company for 5 years and due to personal reasons, I decided to resign from my company.

I am willing to render a notice period, however, my company advised that they will file a case against me.

Is this legal?

Greetings.

You have the right to resign at any time.

No one can force anyone to work for him, and he cannot file a lawsuit against you.

Can you send your employment contract so that we can review it and be able to advise you correctly?

No, they can not.

You can serve the notice period and then leave the company.

Dear Questioner,

They can not file a case against you based on the reason of resignation.

Only they can claim the visa cost incurred for the renewal if it is particularly mentioned in your employment contract.

Otherwise, you can leave the job after serving the notice period. You may follow the termination clauses mentioned in your employment contract.

Dear Inquirer,

We are pleased to serve you and address your inquiries.

Regarding resigning from work, you can submit your resignation and work during the notice period, thus legally ending the employment relationship.

Dear Questioner,

As per your statement, this should not be legal but you should be serving the legal notice as per the employment contract.

However, we can help you to verify the legal documents including your employment contract, and advise you on the next steps to also guarantee your employment rights.
