Questions & Answers
Is getting married in the UAE as part of a civil marriage recognized in India?
Hello,
Can anyone confirm to me if getting married in the UAE as part of a civil marriage is recognized/can be registered in India?
I am an Australian citizen, marrying an Indian citizen (both with UAE residency). I would rather marry in a civil court in the UAE but understand this may not be valid in India.
I also want to understand the differences and complications of being married under Indian law in case of divorce, rights, etc.
If we were to get married in the UAE under the Indian Foreign Marriage Act, do the Indian or UAE laws apply as the marriage was performed in the UAE?
Getting married in the UAE can be a viable option for you and your fiancé, but there are some legalities to consider due to your different nationalities.
Marriages conducted under the Indian Foreign Marriage Act at the Indian Embassy/Consulate in the UAE are recognized as valid in India.
The Indian Embassy/Consulate in the UAE requires documents like a No Objection Certificate (NOC) proving your singleness from the Australian Embassy (since you're not Indian), along with other formalities.

Dear questioner
The marriage conducted in UAE can be validated in India after attesting the marriage certificate through the Indian Embassy and it can be enforced as per Indian laws.

Hello Ms. R.,
According to Indian law, if at least one party is a citizen of India, they can get married in the UAE under the Foreign Marriage Act.
Even though the marriage was performed in the UAE, if the marriage was solemnized in the manner provided under the said act, then it shall be good and valid as per Indian law.
Regarding matrimonial reliefs/rights, Indian law can be applied if the marriage was solemnized as per the Foreign Marriage Act.
