After winning the RDC case, the tenant refuses to vacate or pay. What now?

Hi,

After winning the first instance in RDC, I filed for execution against my tenant, who refuses to pay and vacate the property.

Upon checking the portal, it showed that the writ notice had been given to the tenant, but there is no scheduled hearing, and the Case Activity is listed as "Case Activated."

Will there be any hearing scheduled, and do I need to make additional requests? Also, when will the eviction date be set?

What steps should I take if the tenant continues to refuse to vacate the property?

Dear Inquirer,

We are pleased to serve you and address your inquiries.

We advise you to submit a request for eviction in your execution case. Request a specific date for the eviction.

If the tenant does not comply voluntarily after the court order is issued, proceed with requests for forced eviction.

Ensure that there are no appeals filed by the tenant against the decision of the Court of First Instance.

If anything else is required, don’t hesitate to contact us via email or call our offices in Dubai or Sharjah.

We understand your concerns. We need to review the judge's remarks or determine the reason for the delay in execution, as there is no hearing posted at all.

To assist you with the next steps to be taken, we require the case details. If you would like to proceed with us, please share your WhatsApp number.

Can you please tell me more about how the execution process should look like, and should there be any hearing at all?

When the date for eviction is set; when registering the case or will there be a court order after that?

Will I be notified or will they send it only to the tenant?

Normally, there will be a hearing for the execution stage. The court will issue a date for eviction and the enforcement will also occur.

Both the parties will be receiving notification as well.

Kindly update your review.
