Can I file a complaint against my company for delaying my salary 5 months?

Hello,

I have been working in the UAE as an expatriate for the past 7 months in a company but they are delaying my salary for multiple months.

I have pending salaries of 4-5 months, and no proper response while asking. They didn't provide medical insurance also to the employees as per the UAE labor law.

All the employees have had these salary delay issues for the past 3-4 years. They are not fulfilling the salary increments or whatever benefits they accepted during the interview.

How to handle this situation.

Dear questioner

As per UAE Labor Law, the company shall deliver the salary in proper time without any delays also it is mandatory to provide medical insurance to the employee if you are working in a mainland company in the UAE.

You can raise a dispute in MOHRE through their website or you can file a complaint with the free zone authority.

If you need further clarification, please share your Whatsapp number.

Greetings.

It is not permissible for the employer to delay salaries in the Emirates. They must adhere to the workers’ wages and pay through the wage protection system.

Otherwise, a complaint must be submitted to the Ministry of Human Resources and Emiratisation.

Hello

Since the delay is happening on a regular basis, you should report it to MOHRE.

Dear Sir,

We understand this situation is stressful for you and other employees facing salary delays and lack of benefits.

Understand your legal rights:

• Salary: According to UAE labor law, your wages are due by the 1st day of the month following the pay period. Delays exceeding 15 days are considered illegal unless specified in your contract.

• Medical insurance: Employers are legally obligated to provide medical insurance for all employees in the UAE.

• Salary increments: Discuss your contract and any agreements about raises. If promised, they should be fulfilled.

• Talk to your employer: Try to have a calm and professional conversation with your employer about the delays and missing benefits. Ask for a clear explanation and timeline for resolving the issues.

• Contact the Ministry of Human Resources and Emiratization (MOHRE): File a formal complaint through the MOHRE website or by visiting their service centers. They will investigate and take necessary action against the company.

• Document everything: Keep copies of your employment contract, pay slips, communication with your employer, and any relevant evidence.

• Gather support: Talk to other affected employees and consider forming a group to file complaints collectively. This can strengthen your case.

Please feel free to contact us for further legal assistance.

Regards.
