What to do if the previous company's failure to renew insurance led to a fine?

My brother's company has not renewed his insurance since April 2023. He was not aware of this until he switched companies in December 2023.
Now, the new company is processing the insurance details, and they have informed him that there is a fine to pay.
They advised him to talk to the previous company about settling it. However, the HR from the previous company is avoiding my brother and not responding to his calls or messages.
In this situation, will he have to end up paying the fine? Or can we file a police complaint against the employer? Can you please advise?
