السلام عليكم ورحمة اللهعادة تمنح هذه الشركات نفسها فترة سماح سنة كاملة بدون أي غرامات مالية عن التأخيروالمشتري يجوز له المطالبة بغرامات التأخير اذا تأخر التسليم الى ما بعد فترة السماح عندها يجوز له اللجوء الى دائرة الأراضي والأملاك كما يجوز له المطالبة بأي غرامات تأخير نص عليها العقد.

Q: We are based in England, and we have invested in one of the projects called Lawns III at Jumeirah Village, Dubai in April 2009. We paid about AED 448335 to a company called DEC LLC, P.O. Box 333876, and came to know that the project did not even start. Now, we are chasing to get the refund with no answer from them and would like to know our right to get the refund in full with no delay. Q: I bought an off-plan property in Abu Dhabi. The developer is now (I believe) in breach of contract due to delays. I have paid 3/4 of the property cash, however, I don't have visibility or confidence on when the apartment will be ready. What are my chances to get my investment back? How long would it take? Refund for delay in possession of apartment and compensation

Q: I bought an off-plan apartment in a tower in Dubai. 10+ years later, it still has not been finished and I have paid in full. Yet, they keep coming back to me and making changes and asking for more money. The latest is about the size of my apartment. They are saying that it's bigger than what I agreed to and want me to pay more for the extra space. In addition, they are asking for some electrical money, yet the apartment has not been finished. I feel they are asking for money that is not due. They send threatening emails for payment with no explanation. As I have no knowledge about Dubai law and do not live in Dubai, I feel they would act differently if they had to speak to a knowledgeable person.

هل يجوز للمطور الإخطار بإنهاء العقار بعد رفع المشتري دعوى قضائية بسبب التأخير؟

س: السلام عليكم، اشتريت وحدات عقارية وقد تأخر المطور عن الميعاد المتفق عليه للتسليم وحتى بعد المهلة المتفق عليها للتسليم. سجَّلت دعوى نزاع عقاري ونُدِب خبير وأودع الخبير تقريره وبناءً عليه سجلت دعوى نزاع عقاري بالمطالبة باسترجاع المبالغ المسددة للوحدات المشتراة لإخلال المطور بالتسليم في الموعد. في أثناء نظر الدعوى، أرسل المطور بريدًا إلكترونيًا لي بجاهزية العقار للتسليم. السؤال هنا: هل يجوز قانونًا للمطوِّر إخطاري باستلام الوحدات بعدما سجَّلت دعوى قضائية قبل تاريخ إخطاره لي بجاهزية العقار؟

Can the owner of a company escape if there is a cheque execution and travel ban on him?

I raised a cheque execution case against a company and its owner and won. There is a travel ban on him. I was receiving installments for three months and now he stopped paying. The court after request summoned him. In total, he paid only 30% of the owed money. I found that his company license is expired and also in the month his visa will expire. Does he have any option to avoid payment? Please note he was deceived by showing no money in his bank account and no assets in his name but he is running multiple businesses. Also a month ago, he tried to convince me to lift the travel ban but I refused to do so. But he submitted a guarantee and left UAE. Now the status shows he is back in the UAE and the travel ban imposed again. But after that, he stopped payment. Is there a 1% chance of him not paying me the remaining money? Is there a way he can leave the country through the Amnesty program or any of this sort?
