Q: I requested the bank to restructure the outstanding loan for an extended period, with the remaining amount being AED 150,000.
The bank informed me that the new term would be 48 months, but I later received an agreement for 72 months. Upon noticing the discrepancy, I declined the offer, and as a result of the dispute, the bank filed a criminal case against me.
I paid the fine and resolved the issue with the court. Now, after 7 years, they have initiated a cheque execution case for AED 300,000 with a travel ban.
I have an email from the bank stating that the liability is only after the case has been filed AED 150,000. The signature on the cheque is mine, the rest of the details were filled in by the bank, including the total amount of the monthly dues for 72 months.
How can I proceed in this case?
I intend to request an installment option for the original amount of AED 150,000, without any applicable interest discounts as mentioned on the cheque and the case value.

Q: Hello,
I left the UAE more than a year ago after losing my job and leaving behind a pending amount of AED 400K from a personal loan at a bank (a police case and a ban is already in place), of course.
Now, the ACC is showing a higher amount due to fees. However, I was told that banks might consider settling the matter for lower amounts of the pending.
Therefore, I am wondering if someone has experience in negotiating these bank debts in the UAE, and if that information/possibility is true.

Q: Hi,
I took a personal loan from a bank in 2018 for AED260000 then I left the country but continued to pay for a while. One month ago in Dec 2020, they have filed a civil case.
If I hire a lawyer for my case to clear, would that help to solve the issue or should I try contacting the bank to negotiate?
I am not sure if the bank will be willing to negotiate to close the outstanding as I was told by a friend, that banks have insurance on the debt that is lent and if there is a civil case they can claim insurance for the lost money rather than negotiating with the borrower, especially after a civil case is registered. Is that true?
I want to clear my name at the earliest but I don't have that much money (now it is AED 293000 with interest and late fee). In a civil case, what are the proceedings if I hire a lawyer?
Does it help to get the amount of payment lowered via court? If so, how much lower can the court order to close the case and how long would it take?

Q: Hi,
I have received a message from a finance company legal team stating that my file has been sent to start filing a civil case for my personal loan for which I defaulted on its payments.
Total loan: AED 98,000
Tenure: 120 months
Interest rate: 39.99
Amount Paid: 36,740
No. of Months Pending: 109 pending
Amount Pending: 364,060
Principal Amount Pending: 94,547.65
During my settlement discussions, I requested to take into consideration the amount that has been paid towards my loan: 36,740 AED, however, this request has been rejected, and it has been proposed to pay AED 80,000 in one shot.
I also requested multiple times to receive the statement of all payments that I made. Requests have been rejected and I have submitted a complaint to the Central Bank which is still under investigation
How can I better negotiate a settlement that is more reasonable in order to avoid a civil case?
Moreover, what are the procedures of a civil case knowing that a travel ban will be imposed until the entire amount is cleared?

Can I request the court to change a cheque case payment plan from monthly to quarterly?

Q: The court has ordered me to pay a certain amount of money (3000 AED) on a monthly basis via the Amanat system (200 AED charges per transaction) until I fully paid the required total amount on my case (cheque settlement for 100K AED).
My question is, can I possibly request the court to change the mode of payment on a quarterly basis, and then I will make the payment? The triple equivalent amount of AED 9000 instead?
Please advise.

My company has filed a complaint against me in MOHRE related to training fees.
This is the clause mentioned in my contract:
"The Second Party shall be obliged to pay back the value of the training (which is estimated at an amount of 10000 AED) when they terminate the employment contract based on their own free will (within One Year) from the date of commencement of their contract, without prejudice to the First Party's legal or contractual obligations. (the amount agreed on for the value of the training period must be commensurate with the employment period of the employee)"
My question is:
1. I served 11 months in the company. Can they demand the full 10,000 or it should be less due to 11 months (as per the last line of the clause)?
2. I didn't even get training from the company. I learned normally by working on projects with seniors. No training session was conducted for me. Should I still have to pay?
My case is in MOHRE.

I was evicted from my apartment after living there for five years. My landlord informed me a year in advance that the lease would not be renewed because he intended to sell the property.
Prior to this, he attempted to impose a rent increase that was not compliant with RERA regulations, which I refused to accept. He then served me with an official Dubai Court eviction notice, citing the need to take back the property for sale.
Five months after I moved out, I discovered the property was rented out at a much higher price. Upon further investigation, I found that the ownership was transferred as a "Gift" rather than a sale.
This makes it seem like the eviction was only to raise the rent rather than a genuine need to sell.
Do I have a valid case for wrongful eviction against my landlord?
Also, under Dubai law, does transferring ownership as a "Gift" hold the same legal grounds as selling in justifying eviction?

I am a 50% partner in a company. I had given a 2M AED loan to the company about 10 years ago. There are expert reports and bank records to prove the loan.
The company does not have any bank balances or assets. Should I start a lawsuit against the company and demand 2M AED, or should I start a lawsuit against the other 50% partner and demand 1M AED?
One benefit of suing the company is that I can obtain an acknowledgment of debt, and later in an execution case, I can issue a certificate of solvency to have the other partner arrested.
However, suing the other 50% partner directly would include their name in the executive writ. Please guide me!

I bought a property and the seller sent the tenant an eviction notice but he refuses to leave. What to do? 0
I bought an investment property last year on the condition that the landlord serve the 12-month notice specifically for the purpose of selling the unit and gave the tenant the notice.
The landlord sent a court notice of 12 months for selling the property which was sold to me.
Plus at the time of renewing the lease with the new landlord (myself) during these 12 months. It was mentioned in the contract that the landlord will not renew.
It was also mentioned that the validity of the contract is until the date of court notice.
The landlord sold the property as per the notice.
The tenant got their 12 months. Now the tenant is refusing.

We would like to ask for legal advice. Our company is currently renting a warehouse, and our contract ends in June. We have just received an email from the landlord stating that they do not wish to renew our contract once it expires.
Please note that we were informed through a regular email, not via an Emirates Post registered email or Dubai Courts. They mentioned that they will use the warehouse for their own purposes.
May I know if this is allowed, considering we were given only three months' notice?
As I understand, a one-year notice is required for eviction. Does our case fall under eviction?
