What if the landlord does not collect rent and later files for immediate eviction?

Hello,

My landlord is not agreeing to meet to pick up the checks for the rental unit I am living in, and he is also not confirming any other alternative way of payment. I know he wants to send an eviction notice to me in the future.

Can he use the above against me? How can I make sure that he cannot claim that I am not paying, as he is the one who is not agreeing to meet?

I have sent him three reminders already. Would appreciate your recommendation on this.

Dear Questioner,

Maybe the landlord is trying immediate eviction upon the failure of the payment of the rent.

It is better to contact the landlord by proper channel like email and remind him of your willingness to pay the rent and his negligence to collect the cheque. So if any dispute arises, we can use this as evidence.

Dear Questioner,

You can use the reminders as proof that you have made an effort to pay the rent. Keep a record of the reminders sent to the landlord.

In case the landlord claims that you have not paid the rent, you can provide evidence of the reminders sent.

Hello,

If the landlord refuses to accept the rent, you should deposit it with RDC.

This way, the rent will be officially and legally offered to the landlord, and at that point, the landlord cannot evict you from the property due to non-payment of rent.
