Questions & Answers
Landlord's non-acceptance of rent for 8 months. Can I face eviction?
Dear Sir/Madam,
Rental Dispute - The management agency in my current apartment building has issued a verbal notice via a telephone call to all residents (in January 2024), asking to vacate the premises by 25 February 2024 citing that they're planning a major renovation to the entire building.
My contract had expired in June 2023. Despite multiple follow-ups (over email, I had told them I wanted to renew starting March 2023), they never responded to emails and delayed the renewal.
I had come to know that there was an ongoing inheritance battle between the owner's family which may have been the cause of delay.
Please advise on the below:
1. As I have not paid any rent since June 2023 as they never accepted the cheques, can they issue an eviction notice based on non-payment of rent?
2. Would I have any legal recourse to fight this notice?
3. What is the overall timeline/expense for such rental dispute cases to be resolved?
4. Are there any other legal actions that they can take against me?
Dear Sir/Madam,
For your first question, yes they can issue an immediate eviction notice for the default of rent according to the rental laws of the UAE.
If they are not willing to accept the cheque, you can make a motion and deposit with the court and you can avoid this default as well.
The whole case can be dissolved within 1-2 months. The expenses can be discussed in detail.

Dear Questioner,
1. Verbal notice is not sufficient for the landlord to take eviction action against you.
2. The contract is considered automatically renewed with the same conditions as long as one of the parties does not send a legal notice of termination of the contract.
3. As for paying the rent, this is a big problem that should be solved by going to the Rental Disputes Resolution Center, submitting a request for an offer, and depositing checks in order to protect yourself from the landlord’s request to vacate the property for non-payment of the rent.
4. It does not usually take a long time, and its cost is usually not large.

Kind Regards,

Hi,
As you have not paid rent since June 2023, the management agency may have grounds to issue an eviction notice based on non-payment of rent.
However, it is important to note that they cannot evict you without following the proper legal procedures and obtaining a court order.
2. You may have legal recourse to fight this notice if you can prove that the delay in renewing your contract was due to the management agency's actions or inactions.
You may also have a case if you can prove that the renovation plans were not communicated to you in a timely manner and that you were not given proper notice to vacate the premises.
3. The timeline and expense for rental dispute cases can vary depending on the specific circumstances of your case and the efficiency of the court system.
4. The management agency may take legal action against you for non-payment of rent or for breach of contract. They may also withhold your security deposit if there are any damages to the property.
Dear Client,
Thanks for your question! I hope you are doing well. I will assist you in this matter.
In response to your rental dispute:
