Requesting additional fees due to cheque postponement. What should I do?

Good day,

I requested the lessor to divide my upcoming cheque into two payments instead of the full amount on the 1st of December. I paid 50% on 1st December, and the second payment was scheduled for 30th December.

However, they considered it as a cheque postponement and asked for an additional fee.

Upon reviewing the contract, I found point number 8 states that a cheque postponement request will be subject to management approval, and it doesn't mention any extra fees—just approval.

Is this normal, and should I pay for it, or not?

Please help!

Dear Questioner,

Since they already mentioned management policy, then it will be their discretion. You can make a request to the management regarding the fee.

It's a normal procedure followed by the authorities. You may send them a mail regarding the same.

If you need further clarification, we will arrange a legal consultation session for a charge.

Dear Questioner,

There are several dimensions for this particular situation. If the same has not been mentioned in the contract, you are not obliged to pay the same.

But "subject to management approval" means the management has the discretion to decide upon this matter.

Now, you may send them a mail to avoid the same. This will be the best option.

If you need further clarification, we will arrange a legal consultation session for a charge.

Dear Client,

Thanks for your question! I hope you are doing well. I will definitely assist you in this matter.

Review your lease agreement carefully, paying attention to clauses about cheque postponement and fees.

If the agreement states that cheque postponement requires management approval without specifying extra fees, discuss the matter with your lessor.

Seek clarification on the fees they are requesting and attempt to negotiate a mutually agreeable resolution.
