Does judge's order to renew tenancy contract overrule eviction notice?

Hello,

Yesterday, I won a case against my landlord. The judge ordered a renewal of my tenancy contract for one (1) year, and the landlord must pay the expenses (3% of my annual rental).

However, the judge is aware that I received an eviction notice from my landlord.

As a result, I can only get an 8-month tenancy contract, not a one-year contract.

Does the judge's verdict of a 1-year contract renewal supersede the eviction notice, which only allows for 8 months?

If so, must the landlord accept the renewal for 1 year instead of 8 months?

Hi,

Pursuant to your query, the contract will be renewed for 8 months as the notice is already served.

However, if the landlord agrees to renew the contract for 1 year in accordance with the judgment, then you will have to evict the apartment after 1 year.

From my understanding; since I got the judge's verdict for 1 year, the landlord should accept it, as long as he doesn't appeal within 15 days of the verdict issuance, not sure honestly.

This renewal judgment has a temporary validity.

The landlord can file his lawsuit upon the completion of the eviction notice period without this judgment having any effect.

It seems like I will be prone to a lawsuit if I don't follow the period in the eviction notice, however, I don't think the landlord can reject the judge's verdict if he doesn't appeal within 15 days.

According to this judgment, the landlord must allow you to access the property and provide you with Ejari so that you can use the property until the expiration of the notice period.

At that time, you will see whether the landlord is determined to vacate or not.

According to the judgment you sent, the term of the lease starts on 10/09/2023 and expires one year after this date.

That is, it starts on 10/09/2023 and ends on 9/09/2024.

That's correct Younis, however, as per my eviction notice, I have till 11th May 2024, which is 8 months only, that's why according to the judge's verdict, I have the right to renew the tenancy contract for a year, which in my opinion supersedes the eviction notice.
