قدم المستأجر إشعارًا مبكرًا ولكنه لم يقم بالتوقيع: هل يمكنني تغيير الشروط لمنع الإنهاء المبكر؟

سيدي/سيدتي العزيز/ة،

ينص عقد إيجاري على فترة إشعار مدتها شهران وغرامة إيجار شهرين للإنهاء المبكر.

بعد أربعة أشهر من بدء العقد، أرسل لي المستأجر إشعارًا عبر البريد الإلكتروني يفيد بأنه اختار الإنهاء المبكر، لكنه اختار الاستمرار بالعقد في التاريخ الذي كان من المفترض أن يُخلي فيه العقار.

هل يمكنني السماح له بالاستمرار بشرط ألا يكون بند الإنهاء المبكر متاحًا له بعد الآن، وأن يُلزم بإكمال كل عقد سنوي يُجدده مستقبلًا، لأن أقواله لم تعد محل ثقة، وأفعاله أفسدت خططي وسببت لي صعوبات مالية بصفتي المؤجر؟

Dear Questioner,

No, you cannot impose such a condition on the tenant.

According to UAE law, the tenant is allowed to terminate the tenancy contract early, provided they give the required notice and pay the penalty.

If the tenant has chosen to continue in the contract, then you must accept that. You cannot impose any additional conditions on the tenant.

The contract still continues with the same tenant as he has not vacated the property.

If you want, you can send him an eviction notice to evict him from the property since he has already mentioned his intention to move in proper communication. Otherwise, you can let him stay.
