The notice period for termination of the tenancy contract

Dear Sir/Ma'am,

I have rented a studio in Discovery Gardens, it was for 3 cheques and the tenancy contract started on Jan. 11, 2018. My first cheque was paid to cover the period until May 11, 2018.

My issue is I am getting another job outside the UAE and I plan to vacate and terminate the contract on March 11, 2018.

My question is, can I still get the remaining amount of 2 months or it can be used as a penalty for breaching the contract?

Dear Questioner,

Basically, we should review your tenancy contract before providing you with an answer to your question and know if your contract mentions that you rented the studio for one year starting Jan. 11, 2018 to Jan. 10 2019.

You might have a problem with your landlord for early termination of the contract unless you have clear terms in the contract regulating such occasion.

You should abide by the notice period mentioned within, and you will be liable to pay the penalty in addition to that.

However, your landlord should be cooperative in providing you back the rest of the cheques provided to him/her for the balance of the period.

Hi Sir Ahmed,

Thank you for the feedback, it is highly appreciated.

The addendum in my contract states that there shall be a penalty of 2 months if I breach the contract.

Does it mean I might pay 2 additional months more or the remaining payment of 2 months would serve, as I will vacate the unit on March 10, 2018?

I cannot answer this question before I review the contract. It is basically based on how the contract and its articles are drafted.
