هل يمكنني تمديد عقد الإيجار إذا تم بيع الشقة وأرسل لي إشعار إخلاء؟

مرحبًا،

باع مالك الشقة شقتنا وأرسل لنا المالك الجديد إشعار إخلاء. ينتهي عقدنا الحالي في 31.1.2024 وتلقينا إشعار الإخلاء في 17.7.2023.

سؤالي هو ما إذا كان إشعار الإخلاء يجب أن يذكر التاريخ الذي نحتاج فيه إلى الخروج. من وجهة نظري، فإن إشعار الإخلاء لا يقل عن 12 شهرًا، لذا فقد يكون أطول.

من الواضح أننا نريد عقدًا آخر، لذا فأنا أبحث عن طرق لتحقيق ذلك. بالإضافة إلى أنها وضعت السبب في أنها تريد استخدامه لنفسها أو أحد أفراد أسرتها من الدرجة الأولى.

على أي حال، اشترت أيضًا شقة بجوارنا وأرسلت بريدًا إلكترونيًا إلى زوجي بأنها ستنتقل إلى هذه الشقة بجوارنا في يناير 2024، وتريد نقلنا حتى تتمكن جدتها من العيش بجوارها.

قرأت أنها لا يجب أن تمتلك عقارًا آخر إذا أرادت استخدام هذا السبب لطردنا، خاصة إذا كانت تمتلك شقة أخرى وتستخدمها لنفسها.

إذن كيف يعمل الأمر في الواقع؟

هل هناك أي طريقة يمكننا من خلالها القيام بشيء قانوني لجعلها تمنحنا عقدًا كاملاً آخر؟

If she or her next kin wants to move into the apartment, then they can send an eviction notice.

If they re-rent the property to a third person, then only your right is violated. They will be giving you a renewal till to the date of eviction.

If she has more than one apartment to stay in, then there is a slight possibility for you.

Hello,

Thank you for your answer.

The thing is she emailed my husband that first, she bought an apartment next to us, and then her relative got sick, so she wants to move this person to our apartment, so they can be neighbors.

She sent my husband the document showing that she is the owner of the apartment next to us and also of ours.

Even if both are 1 bed, can she use both for her personal use and use it to evict us sooner?

We want to have one more contract for 12 months. She gave us notice on July 23, contract finishes on January 24.

So if she will move into the apartment next to us, which is hers, is her notice actually valid?

Also, does the notice need to state the date when she wants us out?

Because if the notice is a minimum of 12 months and it doesn't state a date when we need to vacate the property, does it mean she has to give us a contract for 12 months?

Hi

You will have to vacate the apartment as the landlord has followed the law, served you with the legal notice, and gave you a 12-month period.

You can ask the landlord to renew the contract till the end of the notice period.
