How can I clear my absconding case and leave the country if the employer refuses?

Dear Sir/Madam,

I was working with a company in Abu Dhabi. My visa was canceled on 26-10-2022 and my grace period expired on 26-12-2023. I could not depart the country due to an active case against me.

I cleared the court-imposed fine on 26-01-2023 and received a clearance letter. Then I approached immigration to pay my overstay fine to exit the country.

But the immigration officer advised me to clear my absconding with the employer first then go to pay or reduce the overstay fines which I'm completely not aware of.

Then I approached my employer to give me a NOC or lift the absconding case against me and I agreed to pay any associated charges.

But my ex-employer refused to clear my absconding case and told me that they can't do anything in this matter and were advised to take out a pass to exit the country.

Based on my above statement, please advise me to remove my case and return to the UAE for future employment opportunities.

Kind regards,

A. A.

You have two options. The first is to settle it with the employer by submitting a request to cancel, this is the strongest solution.

The second is to submit a request to cancel it with a mercy or pardon request, it’s not a strong solution to cancel but you can try.

Thanks for your valuable response and please advise how and where to submit a pardon request.

You can try to reach Tasheel to remove the ban. We can help you with the matter once you provide us with a Power of Attorney.

I opened a file in April with Tasheel. Almost 4 months passed but still no improvement.

If you want, we can submit the same.

Thanks for your time and immediate response.

If we submit the same again how long this process will take and how much does the service cost?

Because I'm running out of money and for the last 9 months I don't have any income, just surviving with the support of friends myself, and family in India.

However, I assure you that I could arrange the required fee as my final hope.

Rest Allah Kareem.

Thanks again for your time and looking forward to your favorable response.

This will be at the discretion of the authority to accept your request or not.

The process will take 1 month and the charge will be AED 5000 in advance and AED 5000 on removal.

Dear Client,

Thanks for your question, I hope you are doing well. I will definitely assist you in this matter.

In this situation you can take the following steps:

Consult a UAE immigration to resolve your existing position and consider returning to the UAE for work. Try to resolve the absconding issue with your ex-employer.

If they refuse, legal help may be needed to find alternatives. To avoid issues, pay overstay fines immediately.

If your ex-employer is uncooperative, ask for an outpass or other leaving options through immigration. Be aware that your current situation may affect your future employment in the UAE.
