Q: Dear Sir,
I need an advice on my three rental cheques of AED 4800 each, which bounced in Sharjah and the landlord has filed a complaint in Sharjah Police Station.
Alongside, the court has ordered to vacate the place. I have been jobless for the last 15 months and I have told the judge about my condition.
What do I have to do now? As per the new rule on cheque bounce, can I hire a lawyer and pay a fine for my bounced cheque and be released from the police station so that I can apply for a new job?
Please guide me.

Q: Dear Sir,
I have a question regarding my rental cheques, where two cheques got bounced recently.
For the first cheque, I got arrested by the police at Dubai Airport. I paid the fine at Dubai Courts, then they released me.
After two days, one more cheque got bounced and I had already requested to negotiate with the management but they didn't listen. I cannot pay now because I don't have a job.
Now my question is, can I travel to my home country after paying the fine for my second bounced cheque?
Please advise as soon as possible.

Legal consequences of a cheque case in a rental matter

Q: My cousin who had taken flats has a criminal case and case filed at the Rental Dispute Centre. The landlord used his guarantee cheques (empty & signed) to file the criminal case.
But the amount is huge and not true because part of that has been paid.
Since he is overstaying because of this case, he plans to surrender to police and hopefully pay a fine or a short jail term, as he is not able to pay the landlord the amount.
Will the amnesty help his situation in reducing the jail term? Is the case filed with Rental Dispute Centre considered a civil case?
What if the case has been forwarded to court with a judgement of a 1-year term, will he serve the term or can just pay a fine?
By the way, the amount of 2 cheques was more than 200k for each cheque. What should he do to solve this problem?
Would really appreciate your prompt response.

Staying in the premises beyond the tenancy contract

Q: Hi there,
I am staying in my current apartment in Sharjah since 2011.
I haven't renewed my tenancy since July 2018 (almost 10 months now) since I lost my job and struggling to pay my bills and take care of my family.
My building real estate has still not taken any action against me till now. But I'm worried they might go legally against me. Could you please advise what could happen if they proceed legally?
And do I have to pay the outstanding for the last 10 months or can I move to any other place without informing the real estate?

Settlement of a bounced cheque case paid for rent

Q: I had to evacuate the apartment due to a case filed by my landlord in RDC in March 2018 on unpaid rent of AED 30,000. The keys were handed over to RDC.
I am going through severe financial issues and it is very difficult for me to arrange the said amount. The landlord has also filed a case of bounced cheque.
What remedies do I have as my financial situation is quite stressed to get rid of this case?

لدي قضية تنفيذ في محكمة عجمان وتم التعميم على المركبات التي أملكها حيث أنه ترصد في ذمتي لمالك البناية مبلغ 4000 منذ السنة الماضية وقام بعمل تنفيذ ضدي و يقول أنني أشغل العقار إلى شهر مارس 2019.
علماً أن لدي براءة ذمة من الماء والكهرباء منذ أغسطس 2018. راجعت المحكمة وقدمت طلب إلى القاضي فقال أن علي سداد نصف المبلغ من الإجمالي 15500 وإيداع جواز السفر ثم سوف ينظر مرة أخرى.
الرجاء الافادة ماذا أفعل؟

Changing the punishment of a bounced cheque case from jail to fine

Q: I have a bounced cheque case which was filed in Bur Dubai Police Station in December 2016 for AED 80,000/-, and in 2017, the judgment was issued in absentia (One-month jail term).
Please note that I have already paid AED 35,500 to the claimant in instalments even before the judgment was passed. Also, this judgment was issued prior to the implementation of the fine system for cheque value AED 200,000 and below.
My question is, can I convert this judgment to a fine without me visiting the police station or will I have to serve the jail term?
Kindly advise on the possibilities.

What to do when unpaid rent claimed by the landlord is double the actual amount?

Q: Hi,
I have a case in Dubai Land Department about a rental dispute.
This case was about AED 11359 earlier and now when I checked it became 24000, but anyhow, I had paid AED 6000 and now I have to pay 18000 in 3 instalments.
But as I said earlier, this amount is too much and the other party and just made up this amount. I have paid already 18000 and I even have the proof of it, my bank statement and a receipt of 6000.
I want your help if you can sort this out.

How to avoid getting arrested at the airport due to an unresolved rent case?

Q: Will I be stopped at the airport?
There was a verdict against me due to a rent dispute about a year ago.
I was ordered to vacate and pay a certain amount. I did vacate but never paid the ordered amount.
I am wondering if I will be stopped at the airport while trying to exit Dubai for a few days.

Can I file an appeal for a fine in a criminal case judgment if I cannot pay the amount?

Q: I had a criminal case against me and I got fined in that case. Now I can't pay that much of the fine amount. Should I go for appeal first?
Second, I have a lawyer I'm asking him to get the full judgment copy at least we should know the full judgment, so better understand why the judge fined a high amount.
But he is saying that it's not published. How much time it takes to get the full judgment?
Kindly tell me if there are any charges for appeal or any court fees, a how much is it?

What can I do if my rental case judgment came with way higher amount than the original amount?

Q: I have a case related to rent where I had to pay 5,555 and 9,600 for the month (01/02/2023) that we stayed till the evacuation date (01/03/2023) plus the court fees. The total amount is 17,350.
Then he filed an execution order on (09/03/2023) and I received a document with the details, so I had 2 weeks to pay it off but I didn’t so they issued a letter to arrest the defendant on (30/03/2023) then on (09/11/2023) they issued a travel ban, I’m planning to pay it off now in installments.
However, when I went to check for the amount now it says I have to pay 34,000. They included the 5,555 plus the court fees and they calculated the amount of the rent from 14/12/2022 to 01/03/2023 which equals 24,618.
However, that doesn’t make sense because I only have to pay 15,155, excluding court fees, as stated in the letter I received on 09/03/2023.
So what do I do?
Do I have to appeal?

I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August.
Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F.
The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee.
Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this?
Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Tenant always late with payments, hasn't renewed contract. What to do? 2
Hello,
I have a tenant who is always late with their payment. Their renewal was supposed to be last December 2023.
Currently, they have not signed any new contract, provided any new cheques, and have stayed for three months from December until now without paying rent.
Additionally, I just discovered that they have sublet the apartment with partitions, which is clearly stated as not allowed in the old contract.
Please let me know what should I do legally!

Tenant received renewal notice, rejected proposed rent on renewal day. What next? 2
Hi,
We sent a renewal notice to our Dubai-based tenant 84 days before his contract renewal, with a 10% increase in rent.
The tenant neither agreed nor disagreed with the proposed rent and replied on the day of renewal that he wouldn't be paying the proposed rent.
Due to the argument, the landlord decided to reduce the rent, but the tenant has not yet renewed his contract. It has been 12 days since his contract expired.
Kindly suggest what could be done in this matter.

Filing a case for wrongfully encashing a guarantee cheque 1
3 years back I had given a post-dated cheque as a guarantee to a person whom I had to pay the money.
In 3 years time before the due date of the post-dated cheque, I had paid him partially by cash and cheque for which I have his signed vouchers and the PDC cheque details.
He was supposed to return back my PDC on the due date and collect the balance amount that was around AED 4000. The cheque value was AED 115,000.
On the due date, he demanded more money from me and when I refused, he bounced the cheque and filed a cheque bounce case.
He said I gave him a cheque of a closed bank account when he asked the money back and claimed the full amount. I was arrested and had to pay the fine for the cheque bounce case.
With the agreement I have with me and the payment voucher proof, can I sue him back for the false accusation?
And can I claim compensation for spoiling my name and image?
