Q: Hello,
I have just renewed my lease in Dubai a few weeks ago with a property management company, and have been informed today that the property has been sold and I should start interacting with the new landlord.
Should I sign my lease again with the new landlord? Can I refuse to sign a new lease and pay all fees again until the lease renewal expires?

Q: Hi, I have a flat in Dubai freehold and it's tenanted till Jan 2017. Just want to know the law incase I want to sell it and the buyer wants it vacant, what will be the notice to the tenant?And if I want to renew the tenancy contract what will be the maximum notice period shall I put for the tenant to give me before they leave?

Q: My landlord is requesting me to leave the apartment at the end of tenancy period which is in 3 months. He hasn't requested this formally, I mean he only sent an email. Can this be counted?
I do not want to leave as I know the reason he wants me to evict is that he wants to increase the rent on the new tenant since I have been for quite some time.

The tenant's rights in case of selling the rented property

Q: Hi,
We just moved into the apartment (just over a month) and now the landlord says that he had put up the property for sale and rent since 8 months ago, which we were not notified of by both the agent and the landlord.
Considering we had plans to stay for long-term, we have had spent a significant amount on the furniture and the interiors. Now, I have been getting calls for viewings, so please help me understand:
1) Can I prohibit the access of the landlord for the viewing?
2) Can I withdraw from the contract and claim all my expenses after deducting for the days stayed, including the agent fees?

Rights of the tenant in case of selling the property

Q: I signed a lease renewal for an apartment in Abu Dhabi for one year starting 28 October 2019.
The owner is now selling the apartment and the new owners want to evict me with two months notice once they own the apartment.
I have no contract with the new owners. Is this legal?

Can the tenant prohibit the landlord from accessing the property?

Q: My tenant has served 90 days notice and expressed his intention not to renew the tenancy. I did offer a rent reduction and also monthly payments, however, he insisted that they will move out and return to their home country.
We had agreed on a time for an agent to visit and take photos to market the property, however, they are not allowing me or the agent to access the property. Further, he has not accepted any of my many calls or responded back to messages.
Where do I stand legally in terms of gaining access, especially as he has served a written notice to vacate?
My objective is to ensure that I do not have an empty villa once they leave given the tough economic times.

أختي تسكن في بيت مؤجر ولم يدفع زوجها كذا شهر للمالك مع تمهيد من المالك وفرصة لهم، أي السماح بالتأخير مع السداد عند القدرة ودفع الإيجار بما يكملون في البيت.
إلا أن المالك يريد إخراج أختي المستأجرة لأن المالكة تريد أن تعيش في ذلك البيت وقد وكلت محامي لإخراجها.
ما الإجراء الذي سيحدث بحق أختي وماذا عليها أن تفعل؟

Asking a tenant to evict an apartment because it is sold

Q: Hello,
I had taken an apartment for rent expecting to live there for 4-5 years. Considering it, I had spent a lot of money on moving in arrangements for the apartment.
After 3 months of moving in, the owner said he sold the property to someone else. Then the new landlord comes and shared all details of the takeover, and sent me a legal notice to evict the property exactly one year later because the new landlord is coming to stay there.
What can be done to protect the situation? As I know this is quite within the legal grounds, so cannot complain, right?
But in the future, how can I protect my situation? Maybe by a multiple-year contract? Is it valid? What can I do to protect my existing situation, etc?
Could you please help?

إخلاء العقار من قبل المالك الجديد

س: السلام عليكم،
أود الاستفسار من سعادتكم عما يلي:
بتاريخ ٢٠ ديسمبر ٢٠٢١ اشريت عقارًا وسجَّلته باسمي، وهذا العقار مُؤجَّر حتى تاريخ ٩ فبراير ٢٠٢٢ عن طريق المالك القديم (أي بتاريخ الشراء، كان متبقي ٥٠ يوم على انتهاء الفترة الإيجارية).
بصفتي مالكًا جديدًا، أخطرت المستأجر أنه في حالة رغبته في تجديد عقد الإيجار الحالي يجب زيادة الأجرة حسب شروط دائرة التنظيم العقاري أو إخلاء العقار عند انتهاء عقده في ٩ فبراير ٢٠٢٢ لكنه رفض الزيادة و رفض الإخلاء.
أصر المستأجر على دفع قيمة إيجار أقل من سعر السوق وأقل من السعر الاسترشادي لدائرة التنظيم العقاري؛ معللاً ذلك بأنه كان ينبغي عليّ بصفتي مالكًا جديدًا للعقار أن أخطره قبل ٩٠ يومًا من انتهاء العقد، علمًا بأنني اشتريت العقار يوم ٢٠ ديسمبر ٢٠٢١ أي قبل انتهاء عقد الإيجار الحالي بحوالي ٥٠ يوم فقط.
عقد الإيجار الحالي هو باسم المالك القديم حتى تاريخ ٩ فبراير ٢٠٢٢ و ليس باسمي ولم أوقعه. رجاءً أفيدوني بموقفي القانوني مع مراعاه أنني لم أوقع عقد الإيجار الحالي والذي سينتهي في ٩ فبراير ٢٠٢٢ فهو مُوقَّع بواسطة المالك القديم.

My Dubai tenant's rental agreement is ending by the end of September 2024 and the completion of 12 months of legally served Eviction Notice is the end of December 2024.
I have two questions:

How can I reach a settlement with the bank for a mortgage of a jointly owned property? 0
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage.
As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine.
In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this.
I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property.
I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

Can a real estate agency hold a percentage of a property sale until transfer is done? 0
A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property.
The transfer of the property was blocked due to the court order.
According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?
