Issuing a new visa after expiry of old visa during a labour case

I filed a labour case against my employer. The judgement came 10 days back and I am planning to appeal.

Now, I have got a new job offer and also my visa has expired 3 months back which the old company did not cancel or renew as the case was in court.

Can I join the new company with the appeal process underway?

How do I get my visa issue sorted?

It's quite complicated, please assist.
