Cancellation of a visa while having pending labour case

Can I request my employer to cancel my visa even if I have a pending case? They filed a case against me (breach of contract).

Dear Sir/ Madam,

I hope you are doing well. Please be advised that you may ask your employer to cancel your labor card and visa, but not necessary he would accept, especially, you said he has filed a case against you.

In case he would refuse to cancel you may file a claim against him before the Labour Department.

Thank you for the answer. What if I want to settle the case by paying my penalty?

They told me that my case is already in the court. Is it possible that we can settle with them before the hearing and withdraw the case? Because my hearing is on June 5 and I really want to go back in my country.

Dear Sir,

You may settle the matter amicably by paying your Employer the penalty.

However, as I understand they have filed a labour case, as such, you may leave to your country any time during the process of the case whether you have paid and settled the case or not.

And I filed also a case against them. Because the salary in my contract is 2200 but I received only 1500, so if I have penalty they will get it in my contract salary which is 2200.

But I am not into my salary, I just want a cancellation and to exit this country peacefully but my passport is in their hands and they told me that I can't get my passport because I have a court case.

My company told me that I really need to attend the hearing because if I cannot attend they can have a penalty in the Labor and I don't know if its true.

Dear Sir/ Madam,

You need to settle this matter properly.

You need to close the file in the court and to cancel your visa in accordance with UAE laws in order not to get a ban.

Again, I say, if you want you may agree with your employer for an amicable settlement and close the file before the court quickly.

Hello, Sir!

I tried to ask my employer to cancel the case and I will pay for my penalty but they refused to withdraw the case. Then I requested them if I can have my passport they told me that they will give me my passport after the case.

Is it legal to hold the employee's passport? What action do I need to do to get my passport?

You have to cancel your visa from Labour and Immigration.

You may claim your passport by going to police station.
