Q: I would like to know if the actions of my employer are eligible. I have been working for the company for more than 3 years. I got pregnant a few months back and I informed the management of my company about this. I have been told that I can't go on maternity leave and I should submit my resignation letter asap, otherwise, the employer is going to terminate me with a ban or something like this, they did not clarify. I do not want to lose the job. I just want to know if the law protects me in this situation.

Q: Hi Sir/Ma'am, I just want to ask for an advice regarding my status. I'm currently working for over a year already under an outsourcing company with an unlimited contract and they placed me in a hospital. Unfortunately, the hospital cancelled its contract with our company. Now, my company sent me an email with an attachment saying that they will be proceeding with cancelling my employment contract as per Article 113 of the UAE Labor Law. The notice period started last Aug. 22, 2018, and my last working day would be until Sept. 21, 2018. Now, my concern is what are the benefits that I'm entitled to? Will I have a problem with the MOL if ever I'll be employed in the future? And is this basically a termination letter? Thank you and I hope that you could give me some advice regarding this matter.

Q: Is it possible if I file a complaint against my employer to go outside the country even for only one month? I will file arbitrary dismissal because they terminated me for no reason.

س: ما النص القانوني الذي يُجيز لصاحب العمل (شركة بترول وطنية) إنهاء عقد عمل غير محدد المدة لعامل (موظف مباشر)؟ وما شروط صحة إنهاء العقد؟ وهل هناك طريقة للعامل أو الموظف لتجاوز ورفض هذا الاجراء؟

س: عقدي غير محدد المدة وتم توقيعه بتاريخ 12 فبراير 2018 وقد استلمت خطاب إقالة بتاريخ 16 مارس 2020 يخطروني فيه بأن أداوم شهر طبقًا للعقد المُبرَم وأنهم سيعطوني مستحقاتي المالية بعد قضاء هذا الشهر وبعد إنهاء مسؤوليتي بالعمل وتسليمها للبديل. مع العلم أن إقامتي ستنتهي في 19 مارس 2020. ما مستحقاتي وما فترة السماح لي بالبلد بعد إلغاء عقد العمل؟ وهل هذا يعتبر فصلاً تعسفيًا؟

س: السلام عليكم، أنهى صاحب العمل عقدي بعد استدعائي إلى مكتبه. عملت مع المستشفي ١١ شهرًا لا يوجد فيها أي شكوى أو إنذار. طلبت صورة من خطاب الفصل، ولكن طُلِب مني التوقيع أولاً فوقعت حتى أتمكن من تقديم الشكوى بمكتب العمل. صاحب العمل يقول: بما أني وقعت على خطاب الفصل والذي نصه "بناءً على الميل الذي أرسلته، قامت الإدارة بفصلك من العمل"، فإن هذا دليل على موافقتي. ما الرد على هذا؟ شكرًا لكم!

س: أنا مواطن أعمل في إحدى شركات بترول أبوظبي. بعد 5 أعوام تم استدعائي للشركة وطلبوا مني التوقيع على عقد عمل جديد بوظيفة عامل بالدرجة 6 أو 5 علماً بأني كنت بوظيفة مشغل بالدرجة 10، وعلى أن أبدأ من جديد فترة تجربة 6 أشهر بفئة متدرب والعقد السابق لاغي. رفضت ذلك فتم إيقافي عن العمل وإيقاف راتبي وإدخالي للجنة المخالفات بشكل أسبوعي لمدة 7 أشهر دون أن أقوم بأي مخالفة. ثم تم خداعي بأن اللجنة قررت فصلي بقرار تأديبي، وعندما طلبت رؤية القرار ادعت بأنه حتى الآن لم يصل ولكنهم أنهوا خدمتي قبل 4 أيّام. فكيف لم يصل حتى الآن؟ طلبت مني التوقيع لحين وصول القرار ولكني رفضت التوقيع على أي شيء حتى أرى القرار. وبعدها قامت الموظفة بطباعة كتاب الفصل وقام أحد الموظفين بالتوقيع عليه، وطلبت مني التوقيع فرفضت لعدم وجود القرار أساساً وهذا الكتاب باطل. بعدها خاطبوا صندوق التقاعد بطلب شطبي من سجلات موظفي الشركة وادعوا بسبب انقطاعي الطويل عن العمل وأنهم لم يتمكنوا من الوصول إلي لأقوم بالإجراءات، وقاموا بالإجراءات بالنيابة عني وتم صرف المستحقات وقاموا بخصم ربع المكافأة. هل يستطيع القضاء إرجاعي لعملي ان قدمت إثباتات على ما أدعيه؟

The UAE has adopted a major reform in its legislative system that brought about 40 new laws and amendments to the company law, criminal law, personal status, among others. The amendments aim to develop the legislative structure in various sectors, the labor law being one of these, was the most recent. We try in this article to shed light on the changes introduced with the new labor law and their significance on both, the employer and employee.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
