Rejecting a legally submitted resignation of an employee

Dear Sir,

My name is S. Mohamed Raazith.

I have been working in Abu Dhabi for the past 1 year and 7 months, my visa is on an unlimited contract and my notice period is 1 month.

I got another offer from a company which is also in Abu Dhabi. I submitted my resignation on September 4, 2018.

Now, my company is saying that I need to wait until a replacement comes or complete the contract and go like that.

If I go to the Indian Consulate in Abu Dhabi, will they help? I need to join my new company as soon as possible.

Please advise me.

You should follow the terms of your labour contract and the clause on the resignation.

If the contract allows you to resign within one month and you have served the notice period, then you can certainly leave by 4 October.

However, the main thing is that the current employer should have accepted the resignation and you have a copy of that acceptance by email or a hard copy in your possession.

Dear Sir,

I have copy of my resignation which my manager returned because I need to wait till the replacement or else I will complete the contract and go. Like that he returned.

Also, I send the mail to all of my top management.

If the resignation has not been officially accepted, then you need to escalate this to the Ministry of Labour.
