Q: Hi there,
I would really appreciate it if somebody can give legal advice. I am still on the probationary period, one month to be exact and the entry visa will expire on Oct 28.
My employer did not process it yet, and we haven't done with the medical and no Emirates ID yet.
I'm planning to resign from this company and return to my home country because I'm not comfortable and we always have a delayed salary and too much deduction.
The question is, can I resign without paying any compensation to our employer or to the company?

Possibility of a labour ban in case of resignation during probation

Q: I want to resign from my work and I am still in my probation. My employer has given me an entry ticket expiring on November 2, 2018.
I don't have my working visa stamp and never gone through medical. If I resign, do they have the right to ban me for 6 months or 1 year?

Q: I resigned during the probation period. My employment visa was not stamped on my passport, I did no medical and didn't receive Emirates ID.
Then, when I tried to get UAE tourist visa, the agency told me that I'm blacklisted and my visa rejected. My contract before was an unlimited contract.

Do I need to serve the three months notice mentioned in contract if I resign during probation?

Q: Hi,
I just wanna ask if I can resign in 14 days even if the notice period in my contract is 3 months.
I am still under probation period on a limited contract and I have decided to go back to my home country.
With termination, will I still have to pay my employer if they would terminate me?
Can employers refuse to accept these terms with MOHRE that I don't have to pay anything?
Do they have the right to file a case and claim all their rights through the court?
How about the terms and conditions imposed and made in the contract?

I'm an employer and an employee claimed 50% overtime.
The actual overtime working hours were 20% for which extra was added to his salary with the right calculation.
A MOHRE case was logged but it's now in court. Our first hearing is next week (online court sessions).
Do I need to prepare my documents that can be presented in court or do I need to prepare something in advance to show my calculations and proof?

في القانون الإماراتي وعلى الأراضي الإماراتية ما حكم العقد الصوري في هذه الحالة: مقيم عاطل عن العمل أعزب يبرم عقد صوري بمسمى وظيفي مزيف وراتب مرتفع جداً لكي يتمكن من كفالة أهله من الدرجة الأولى والثانية؟
هل يمكن غض الطرف عن هذه الفعلة؟
أم هل ستتم محاسبة هذا الشخص بسبب انتقاله المفاجئ من البطالة إلى الراتب المرتفع؟
وما النتائج المترتبة على اكتشاف العقد الصوري؟
هل سيتم إلغاء كفالة الأهل؟ هل سيتم تغريمهم؟ ترحيلهم؟
وماذا عن الشخص نفسه هل يمكن زجه في السجن؟ لا قدر الله

What happens if I miss my hearing in a labor case against my employer? 0
Salam,
I received an email at 8.25 am stating that my first hearing is at 9 am, but I read this email at 10 am.
Is there any issue as I've filed a case against my employer for salary?
Also, I want to ask when I can apply for the NOC. My 2nd hearing is on 30th march.
And what will the procedure be for this?

أعمل في شركة في العين مند ثلاث سنوات ونصف "منها سنة وعشرة أشهر إقامة تابعة للشركة" وما تبقى كنت أعمل بالإعارة من شركة أخرى. راتبي في عقد العمل 500 درهم ولكن راتبي الفعلي 2500 درهم.
هل يحق لي المطالبة قانونًا على حسب الراتب الفعلي؟
وهل فترة العمل بالإعارة تدخل ضمن أيام المستحقات؟
علمًا بأنني أستلم راتبي بشكل مباشر بإيصال قبض من الشركة، وراتب العقد (500) أستلمه بنكيًا أو عبر فروع الأنصاري.

It turned out to be a fault in the building's construction, which caused condensation in the false ceilings. When the panels were demolished, it was found that they were all full of mold.

New owner in Dubai with no Ejari and previous tenant: What are his rights? 0
Dear Sir/Madam,
I recently purchased a studio flat in Dubai that was previously tenanted under a Tenancy Contract from November 2022 to November 2023.
However, there is no registered Ejari to establish a tenant-landlord relationship in the Dubai Government record.
The previous landlord had given the tenant a year's notice to vacate the flat, which was given six months ago. Now that I have purchased the flat, I have asked the tenant to replace the cheques, but she has refused to cooperate.
Can you please advise me on whether I am obligated to continue the Tenancy Agreement signed by the previous owner, given the absence of an Ejari?
Alternatively, when can I tell her to vacate the flat, or do I have to wait until November 2023?
Secondly, I would like to know if I need to serve the tenant with an eviction notice again to vacate the flat. If so, for how long is the remaining period valid, or do I need to issue a new eviction notice of one year?

My company is asking us to do 9 hrs. duty this Ramadan starting last 8th of April 2023 without overtime pay.
And no one from my colleagues wants to complain as they are scared of what might happen.
Just today, my showroom manager is asking me to extend until 12 pm when I started my duty from 10 am and I am fasting.
