السلام عليكم ورحمة الله وبركاته، السادة الأعزاء المحترمين، في القانون الإماراتي وعلى الأراضي الإماراتية ما حكم العقد الصوري في هذه الحالة: مقيم عاطل عن العمل أعزب يبرم عقد صوري بمسمى وظيفي مزيف وراتب مرتفع جداً لكي يتمكن من كفالة أهله من الدرجة الأولى والثانية؟ هل يمكن غض الطرف عن هذه الفعلة؟ أم هل ستتم محاسبة هذا الشخص بسبب انتقاله المفاجئ من البطالة إلى الراتب المرتفع؟ وما النتائج المترتبة على اكتشاف العقد الصوري؟ هل سيتم إلغاء كفالة الأهل؟ هل سيتم تغريمهم؟ ترحيلهم؟ وماذا عن الشخص نفسه هل يمكن زجه في السجن؟ لا قدر الله أرجو الحصول على إجابة واضحة وشافية وشكراً لكم جزيل الشكر.

Salam, I received an email at 8.25 am stating that my first hearing is at 9 am, but I read this email at 10 am. Is there any issue as I've filed a case against my employer for salary? Also, I want to ask when I can apply for the NOC. My 2nd hearing is on 30th march. And what will the procedure be for this? Thanks

Submitted a resignation letter to my employer, but he rejected claiming for AED 10,000 before he cancels my visa and gives me my passport (he is holding my passport). 10 months of working with him (already completed my 3 months probation). There's also a breach of the contract: 1. Working not on the agreed hours (No overtime compensation paid). 2. Salary delay every month. Any advice to take him on through the appropriate quarters to get my visa canceled and get back my passport? He is claiming 10,000 before he gives me my passport and cancels my visa.

السلام عليكم، أعمل في شركة في العين مند ثلاث سنوات ونصف "منها سنة وعشرة أشهر إقامة تابعة للشركة" وما تبقى كنت أعمل بالإعارة من شركة أخرى. راتبي في عقد العمل 500 درهم ولكن راتبي الفعلي 2500 درهم. هل يحق لي المطالبة قانونًا على حسب الراتب الفعلي؟ وهل فترة العمل بالإعارة تدخل ضمن أيام المستحقات؟ علمًا بأنني أستلم راتبي بشكل مباشر بإيصال قبض من الشركة، وراتب العقد (500) أستلمه بنكيًا أو عبر فروع الأنصاري.

Hi everyone, I rent an apartment. After two days in the apartment, water started leaking from the ceiling. My company is asking us to do 9 hrs. duty this Ramadan starting last 8th of April 2023 without overtime pay. And no one from my colleagues wants to complain as they are scared of what might happen. Dear Sir/Madam, My employer (Federal) signed a 3-year contract with me. They have now given me 3 months' notice, ending my contract in May rather than August, saying that my contract was not renewed. There was no reason given for my non-renewal. My evaluations have been consistently excellent. Further, they are now demanding 3 months of housing allowance be repaid. Is this legal?
