Can I apply for a temporary work permit during a case if the old visa got expired?

I have an ongoing labor case against my employer. My residence visa expired last Jan 11, 2023, and my labor card expired Nov 21, 2022.

I received an offer letter from a company. I applied for NOC in Al Adheed and it has been approved. I will be applying now for a temporary work permit.

My question is, will my temporary work permit application be approved considering my employment and residence visas got expired?

You can submit a request to the court to cancel your visa from your previous employer so that you can apply for a new residence visa under the sponsorship of your new employer.
