ما هي مدة الإشعار للإبلاغ بعدم تجديد عقد العمل؟

مرحبًا سيدي،

أنا أعمل في المطار مديرًا. لقد جددت عقدي في 28 يناير 2020، وهو ساري لمدة 3 سنوات.

في عقدي، ينص على أنني بحاجة إلى إبلاغ صاحب العمل قبل 90 يومًا بعدم تجديد العقد.

تنتهي صلاحية العقد الخاص بي في 27 يناير 2023، وأبلغت المشرفين علي في 16 ديسمبر 2022أنني لن أستمر في عملي معهم بعد انتهاء فترة عقدي.

هل من الإلزامي الإبلاغ قبل الموعد ب 90 يومًا؟ أم أنها 30 يومًا فقط وفقًا للقانون؟

Dear User,

The UAE Labor Law stipulates a minimum of (30) days and a maximum of (90) days' notice period to be included in an employment contract.

This means that employers have full discretion to choose how long the notice period should be within these limits, according to article 43 Federal Decree-Law No. (33) of 2021.

If your notice period in the contract states 90 days, then you should serve the 90 days' notice period upon resignation or non-renewal of the contract, unless otherwise agreed upon by your employer.

It is mandatory to be 90 days according to your contract.

As per the law, it is 30 to 90 days, and in your contract it is 90 days, already matching the law and you are obliged to serve 90 days.

Moreover, if you can't serve the 90 days you must pay the company a compensation of the rest of the notice period, equivalent to your total monthly salary
