Q: We were involved in a car accident last March 2016, we sustained some injuries because of that. Can we still file a case even if it has already been 4 months?
The guilty party was already sentenced for 2 months for drunk driving last April 2016.

Parents liability for the actions of their minor children

Q: I am staying in a building in Al Nahdha, Dubai. The front glass door was broke 3 days back.
According to the building owner and security, my son was standing near the door and it happened because of him.
They say that I have to pay for the damages or they will refer it to the court.
My son is 6 years old, and I would like to know if I am liable to pay the cost of the damages.

Liability of a restaurant for injury caused to customer

Q: Hi.
We had an incident at a restaurant's outdoor event for families.
At their food stalls, there was nowhere any signs that the stalls are hot on the front customer-facing side or even covered.
Kids were running around and accidentally our daughter touched one panel and got a severe 2nd-degree burn. This happened on Friday and we have been to hospital each day to change the dressing and cut off skin.
I wonder if there is any legal action I can take against the restaurant, and what might the outcome be?

Defining liabilities and claiming compensation for a personal injury

Q: Hi,
My mother was visiting Dubai and she slipped and fell as she stepped outside my sister's apartment.
The floor outside the apartment was slippery and wet, the cleaners had removed the mat at the entrance of the door and failed to dry the floor or put any warning signs in that area.
My mother suffered severe injuries, most serious being a fracture at the neck of the femur, which required a surgery. She did not have travel insurance.
I approached the facilities management company about this, and they got the cleaning contractor to settle the hospital bill.
However, my mother has a permanent rod and screw holding her hip and femur together and will never be the same again, so I want to claim compensation.
Do I have a case to claim compensation for personal injury?
Who is at fault, the facilities management company or the cleaning company who provides the cleaning service on their behalf?
Both companies have been ignoring my letters about compensation.

Compensation for an injury accident in a mall

Q: Greetings,
I have a query that I hope you are able to answer.
I had a fall/accident in one of the major malls in Dubai due to their gross negligence and injured my ankle. This happened 10 weeks ago, and I am still being treated for the injury.
I am considering purchasing a Fixed Fee service from you - Drafting and Serving a legal notice to the mall management in regards to compensation.
I would like to know what would your professional fees be if I required your expertise to negotiate a settlement beyond this fixed fee service?

Legal course to determine liability for a school accident

Q: My son fractured his finger in the right hand at school and underwent two surgeries. Another student was responsible for this accident.
The school is brushing it off with no financial or any kind of accountability. They keep telling that parents are responsible for this kind of incidents.
The hospital bill for physiotherapy is piling up. Can I take any legal action against them?

Compensation in tort committed by mall

Q: Greetings,
I am a resident of the UAE. On a visit to one of the most reputed malls in Dubai, I slipped on ice cream that was dropped on the floor by someone else. The mall security was informed and I was taken to the hospital by ambulance that they called for.
I was first diagnosed with a grade 2 inversion sprain on my ankle but 5 weeks from the incident an MRI proves it is a grade 3 meaning completely disrupted ligaments.
Recovery also will go on into months. I am covered by insurance but would like to know if the mall is liable to cover the medical costs completely. I would also like to know if I can claim compensation for the pain, inconvenience and hopefully temporary disability it has caused?

Compensation claim from a hotel after suffering a personal injury for their negligence

Q: I walked into a hotel here in Dubai, and when I got out, I took the glass door in the face, which blew up my nose and then I fell on the floor with my nose pissed blood with cuts on his nose.
The ambulance arrived and they asked me to call in the police, but that could take a long time. With the shock, I did not realize well but on the door, there was no sign that we could not reach it.
The staff told me that it was not the first time that this had happened. I find this super dangerous, so I would like to know what my rights are if I can make a claim against the hotel.

The injured person is entitled to claim damages where he has suffered an injury due to the other person’s wrongdoing. The victim may file a case against the person, who is found guilty in a criminal case or his insurance company if the defaulter has secured himself by insurance. The UAE civil law allows filing a compensation claim for injury damages.

Dear Sir,
I'm Satheesh from Abu Dhabi. For the past 3 years, I was working for a free zone company in Dubai. Our company have clients from both Dubai and Abu Dhabi and doing medical billing services for hospitals and medical centres.
I was working with one of the company's clients which is a government hospital in Abu Dhabi (please note - govt is removing our company by Sept.).
My concern is that the hospital is interested to recruit me as their employee. But I already signed a limited contract with my company which has "Non-competition non-solicitation agreement".
My contract states that I cannot join their clients or competitors for 24 months after my visa expiry or end of service. If I violate this law they will take legal actions and they can ask for compensation (Law no. 8 of 1980 for UAE and Law no. 5 of 1985 for Dubai).
My visa is expiring by Aug 25th, so I'd like to join there.
Can I join this Abu Dhabi government hospital or not? If I join, is there any legal issue I have to face from my company?

Do the local sponsors have financial responsibility for bounced cheques from the company that they are sponsored?
If I got cheques but they were bounced and the person who signed the cheques (managing director) left the country. Company is in labor zone, retail, 2 operating shops.
