Q: My friend has a contract which states that she gets 30 days' annual "paid leave" after every 12 months of a completed work year.
With approved and signed leave, she went on leave, and on return, the company refused to pay her 30 days' salary whilst she was on leave.

Labor rights for the annual leave

Q: My employer does not want to give me the annual leave and when I took one week off to go back to my home country since my mother passed away, he deducted the same from my salary and refused to give it to me.
I have been working for one year and 7 months with the same employer, I think I am entitled to more than one month. What can I do?

The right for annual leave
4
Q: I sent a formal email asking for 12 days annual leave and it was approved. On my last working day before my annual leave starts, the HR guy asked for me and we sat down and he told me that I am out of balance and that I owe them 14 days. I asked him to show me the annual leave forms that I have signed, and according to what I have signed, I only took 14 days in my second year so far with this employer.
My hiring date was in September 2015. He also told me that I have exceeded my balance during the first year and that I have to work until September 2017 with no right to book annual leaves. And that if I resigned or got terminated they are going to deduct those 14 days from my salary.
My question is: can my employer do what he has just done, deny me my annual leave at such a short notice, and can he deduct those 14 days from my salary? Is it my fault that they are not organised? And under what circumstances can I sue my employer with regards to the above?

What can be done if a friend is detained in Sharjah and facing UAE deportation? 0
My friend was detained by the Sharjah Police a few days ago; he had no prior legal issues. Now, it seems he is going to be deported.
How can I find out what the problem is and the reason for his impending deportation? Is there any way to have the deportation order cancelled?
Please help if you can; I have a copy of his ID, and he has no immediate family in this country.

UAE inheritance: should succession for an expat start locally or abroad? 0
My brother-in-law (brother of my wife) has passed away in the UAE. He was the only sibling of my wife, and his mother passed away long ago. He had no children and left behind a widow and father. He had a property mortgaged and one off-plan property. He has a car lease and end-of-service pending with his company.
How and where should we start, and what is the best suitable approach? Should we start a succession certificate in the home country and then present it to the UAE court, or start in the UAE?

Unable to contact my landlord: How do I move out and recover my deposit when the tenancy ends? 0
Hello,
I am a tenant in Shoreline, Palm Jumeirah.
I am currently trying to move out of the property where I have lived for the past two years. However, my landlord has become unreachable, and I have been unable to discuss the return of my security deposit or arrange the move-out process.
I provided the required non-renewal notice two months ago and have made several attempts to contact the landlord via both email and WhatsApp, but have received no response. My Ejari expired two days ago, and the community management has advised that they cannot issue a move-out permit without the landlord's involvement. As a result, I am unable to complete the move-out process or hand over the keys.
Could you please advise what steps I should take in this situation? Any guidance would be greatly appreciated.
Thank you.

Can majority partners remove a partner in a UAE free zone company? 0
We are 3 partners for a Free Zone registered firm in the UAE, and one of the partners is involved with another Company (our competitor) as a partner or in some other capacity, which is unknown.
He has been working for that company and demanding monthly remuneration from our company, and he is also demanding an amount for his exit.
Can we both partners exercise our majority and remove him from the Partnership?

How to exit a joint property mortgage in the UAE after divorce or separation 0
I am seeking legal advice regarding a jointly owned property in the UAE. I remain co-liable on the mortgage; however, due to a significant and immediate change in my financial circumstances, I am no longer able to continue meeting my share of the payments.
The agreed sale of the property has also become delayed and uncertain, increasing my financial exposure and risk. In addition to the financial strain, the situation has had a considerable personal impact. Continuing to be tied to the property, including previously living in the same space as my former spouse, has been psychologically challenging and is affecting my ability to maintain stability and move forward.
Given this, I would like to understand:
What legal options do I have to exit or limit my liability under the mortgage?
Whether a forced sale or similar remedy is possible if the current sale does not proceed?
What immediate steps should I take to protect myself financially?
Please let me know if you are available for a consult.
