UAE inheritance: should succession for an expat start locally or abroad?

My brother-in-law (brother of my wife) has passed away in the UAE. He was the only sibling of my wife, and his mother passed away long ago. He had no children and left behind a widow and father. He had a property mortgaged and one off-plan property. He has a car lease and end-of-service pending with his company.

How and where should we start, and what is the best suitable approach? Should we start a succession certificate in the home country and then present it to the UAE court, or start in the UAE?

Dear Client,

Because the deceased owned assets and had financial obligations in the UAE, it is generally advisable to start by consulting a UAE inheritance lawyer and initiating the appropriate succession process in the UAE.

A succession certificate from the home country may be relevant, but it may not automatically be accepted in the UAE and could require legalization, attestation, Arabic translation, and recognition by the UAE courts.

You should first collect the death certificate, identification documents, marriage and family records, and all documents relating to the properties, mortgage, off-plan purchase, vehicle lease, and employment benefits.

The inheritance process should identify the legal heirs and also address the deceased’s outstanding debts and liabilities before the estate is distributed. Because the case involves several UAE assets and obligations, a lawyer should review the documents and advise on the correct procedure before you begin proceedings in either country.

We are honored to provide you with legal representation. To engage our services or for any inquiries, please get in touch with us. We look forward to assisting you.

Kind regards

Dear Questioner,

Thank you for contacting Al Fahad Legal Consulting.

With regard to the passing of your brother-in-law in the UAE, the handling of his estate, including the mortgaged property, off-plan property, vehicle lease, and pending end-of-service benefits, will generally require completion of the legal succession process before any assets can be transferred, claimed, or settled.

Under UAE law, the first step is usually to obtain the necessary succession documents identifying the legal heirs. Since the deceased passed away in the UAE and left assets within the UAE, the succession process may need to be addressed before the competent UAE courts. Depending on the applicable law, nationality, and personal status circumstances of the deceased and heirs, documents issued from the home country may also be required, legalized, and presented before the UAE authorities.

After the succession process is completed and the heirs are legally established, further procedures can be initiated with the relevant authorities, including the property developer, bank/mortgage provider, leasing company, and employer for the settlement of the deceased’s assets, liabilities, and end-of-service entitlements.

The appropriate approach depends on several factors, including:

  • the deceased’s nationality,
  • religion,
  • country of residence,
  • ownership details of the properties,
  • mortgage status, and
  • available family documents.

Therefore, we recommend reviewing the documents first to determine the most suitable succession route and avoid unnecessary delays.

If you require assistance, our legal team can guide you through the complete process, including reviewing the documents, coordinating the succession proceedings, and assisting with the required applications and communications with the relevant UAE entities.

Please feel free to share the available documents and details of the deceased, and we will advise you on the next steps.

Best regards,

Mohammad Salah, Senior Legal Advisor

Dear Client,

Thank you for reaching out, and please accept my condolences on the passing of your brother-in-law. I am Suhail Rana, Legal Consultant based in Dubai, UAE.

Your enquiry concerns succession and inheritance under UAE law. In general terms, when a person passes away in the UAE, their estate — including immovable property, off-plan units, vehicles, and any amounts owed to them such as end-of-service entitlements from their employer — together with their liabilities such as an outstanding mortgage and a car lease, is dealt with through the competent UAE courts. As a rule, the debts and secured obligations of the estate are settled first, and the remaining assets are then distributed among the lawful heirs (which in a case like this would ordinarily include the surviving widow and the father).

For non-Muslims, the distribution may be governed by Sharia principles, by a duly registered will, or by the law of the deceased's home country where applicable, so the precise shares and procedure depend on the deceased's nationality, religion, and whether a valid will exists. The heirs will normally need to obtain an inheritance/succession determination from the court before the assets can be transferred or sold and before claims against the employer or third parties can be pursued.

Because the outcome turns on these specific details and on the status of each asset and debt, I would need to review the documents to advise you and your wife precisely, and I would be glad to guide you through the full process.

To book a consultation, appointment, or phone call, please contact me directly.

An inheritance certificate must be prepared in his home country, specifying the heirs in detail and authenticated by the UAE embassy. The heirs should then gather and appoint a single person as their representative to receive the inheritance in the UAE.

Dear Client,

Thanks for your query. I am happy to assist you with your legal issue.

You should generally begin by opening an inheritance and estate file before the UAE court in the Emirate where the deceased lived or held the assets, because UAE court orders will be required to deal with the properties, mortgage, vehicle lease, and employment dues.

A home-country succession certificate may be obtained in parallel if required to establish the heirs or apply the deceased’s national law, but it must normally be legalised and translated into Arabic and may not, by itself, transfer UAE assets.

Collect the death certificate, passports and IDs of all potential heirs, marriage and family documents, title deed and off-plan contract, mortgage and lease statements, employment records, and details of any registered will; inheritance shares will depend on his religion, nationality, and applicable law.

Our team of legal professionals is available to open the UAE estate file, identify the lawful heirs, and coordinate recovery and transfer of all assets.

Thanks and Regards

Dear client,

Thank you for your detailed explanation, and please accept our sincere condolences for your family's loss.

Based on the information you have shared, the most appropriate approach is generally to initiate the inheritance and estate proceedings in the UAE, as the deceased's assets and liabilities are located here, including the mortgaged property, off-plan property, employment end-of-service benefits, and vehicle lease. The UAE Court can open the succession file, determine the legal heirs, and issue the necessary orders to deal with the estate in accordance with the applicable UAE laws and conflict-of-law rules.

Whether a succession certificate from your home country is required depends on several factors, including the deceased's nationality, religion, country of domicile, whether a valid will exists, and the jurisdiction where it was issued. In some cases, foreign inheritance documents may be recognized after legalization and attestation, while in other cases the UAE Court will require local succession procedures before the estate can be administered.

To provide accurate legal advice tailored to your case, we would be pleased to review the relevant documents, including the death certificate, passport/Emirates ID of the deceased, details of the assets, and information about the heirs. Following our review, we can arrange a free legal consultation (15–20 minutes) with one of our legal consultants to explain the appropriate legal procedure, expected timeline, and the most effective strategy for handling the estate in the UAE.

My name is Eslam Hegazy, Legal Consultant at Abdullah Al Otaibi Advocates & Legal Consultants, and I will be personally handling your matter and guiding you throughout each stage of the process.

I look forward to assisting you and helping your family complete the estate administration process in the UAE as smoothly and efficiently as possible.

Regarding the query, navigating the estate of a deceased expat in the UAE with complex assets like a mortgaged property, an off-plan purchase, a car lease and end-of-service benefits requires opening a formal succession proceeding rather than relying on a home country certificate, which involves lengthy attestation delays and jurisdictional hurdles.

Because the estate involves liabilities including active debts, mortgages and asset distribution among a surviving widow and father, handling these overlapping claims without legal coordination risks asset freeze complications or personal liability for debts.

Kindly share your WhatsApp number for further legal assistance.

Dear Inquirer,

Thank you for reaching out and sharing the details of your situation.

Based on what you have described, matters involving estate administration, succession, inheritance of assets located in the UAE, and the settlement of liabilities following a person's passing require a careful legal assessment to determine the appropriate legal process and the available options under UAE law.

We can arrange a 15-minute triage with counsel to review the relevant family details, the deceased's assets and liabilities, and any available documents, and guide you on the available legal options.

To proceed, we would first need 6 basic details to ensure the matter is directed to the appropriate lawyer.

Hello, hope all’s well.

Losing a family member is difficult enough without having to navigate inheritance, property, and financial matters across multiple jurisdictions. Since your brother-in-law owned assets in the UAE, including real estate, employment benefits, and vehicle finance, it's important to approach the estate administration correctly from the outset to avoid delays.

In most cases, where the deceased's assets are located in the UAE, the succession and estate procedures generally need to be addressed through the UAE courts, regardless of whether inheritance proceedings are also required in the home country. The appropriate process will depend on factors such as the deceased's nationality, religion, domicile, the location of the assets, and whether a will exists. The mortgaged property, off-plan property, end-of-service benefits, outstanding liabilities, and the rights of the legal heirs all need to be considered together before determining the correct legal strategy.

Please feel free to contact us. We can guide you through the UAE succession process, assist in obtaining the necessary court orders, coordinate the transfer of assets, liaise with the developer, bank, employer, and relevant authorities, and advise on whether any documentation from the home country will be required as part of the process.

First, obtain a death certificate and ensure its issuance and attestation if necessary.

Then, open an estate file with the competent court in the emirate where the deceased resided or where their assets are located.

The court will request a list of heirs and issue a certificate of inheritance (or declaration of inheritance) or appoint an estate administrator if required.

Once the necessary documents are issued, they can be used to deal with:

  • The Land Department for real estate.
  • The real estate developer for properties under construction.
  • The deceased's employer for end-of-service benefits.
  • The bank (if the deceased had bank accounts).
  • The finance or car leasing company.

For assistance, please contact us by phone or WhatsApp.

Greetings from Dr. Khalifa Bin Huwaiden Advocates & Legal Consultants.

The appropriate first step is to open an inheritance (succession) case in the UAE, as the deceased's assets and liabilities are located there.

Once the UAE inheritance certificate is issued, the estate can be administered, including claiming the end-of-service benefits, dealing with the mortgaged and off-plan properties, settling outstanding liabilities, and distributing the estate to the lawful heirs.

Given the number of authorities involved and the complexity of the procedures, appointing a lawyer under a Power of Attorney from the outset will save time, protect the heirs' rights, and ensure the matter is handled efficiently. We would be pleased to represent you and manage the entire inheritance process on your behalf.

Hi,

Thank you for your message, and I am sorry for your family's loss.

This is something we can assist with. As your brother-in-law left several assets and liabilities in the UAE, including a mortgaged property, an off-plan property, employment/end-of-service entitlements and a vehicle lease, I would recommend first establishing the correct UAE succession procedure and identifying the legally recognised heirs before taking steps with each asset.

I would not recommend obtaining a succession certificate in your home country first without reviewing the circumstances, as the appropriate procedure will depend on factors including:

  • the deceased's nationality,
  • his religion,
  • whether he left a Will,
  • his UAE residency, and
  • where the properties are registered.

Please send me:

  • Death certificate;
  • Passport and Emirates ID of the deceased;
  • Nationality and religion of the deceased;
  • Details of whether he left a Will;
  • Marriage certificate;
  • Details of his surviving father and wife;
  • Title deeds/Oqood or other documents for both properties;
  • Mortgage details;
  • Employment details and any end-of-service entitlement; and
  • Any available vehicle lease documents.

Once these are reviewed, I can advise you on whether the succession process should commence directly in the UAE, what documents will be required from the home country, and how the properties, mortgage, employment benefits and other assets should be dealt with.

You can contact me directly to discuss the matter and arrange a review of the documents.

Kind regards.

Thank you for reaching out and for sharing the details of your situation with us.

Please accept our sincere condolences on the passing of your brother-in-law. We understand that dealing with estate and succession matters during this difficult time can be both emotionally and legally challenging.

Please send us all relevant documents and information for our review, including:

  • the death certificate,
  • copies of the deceased's passport and Emirates ID,
  • details of his surviving family members,
  • information relating to the mortgaged property, off-plan property, vehicle lease, end-of-service benefits, and
  • any other known assets or liabilities in the UAE.

Once we have reviewed the documents, we will assess your legal position and advise you on the available legal options, including the appropriate jurisdiction for commencing succession proceedings, whether probate or succession documents from the home country would be recognized or required in the UAE, and the most suitable approach for administering and distributing the estate in accordance with the applicable laws.

Hello, dear.

Jurisdiction in this matter is determined by the place where the deceased passed away. If the death occurred in the UAE, you may initiate the legal procedures in the UAE.

However, if the deceased passed away in their home country, jurisdiction lies with the authorities of that country.

Once the death certificate has been issued, it should be duly legalized and authenticated, after which the necessary legal procedures can be completed in the UAE, where the real estate assets are located.

First, please accept my sincere condolences for your loss.

To advise you accurately, I just need a few details:

  1. What was the nationality and religion of the deceased?
  2. Did he leave a registered Will in the UAE or in his home country?
  3. Which Emirate are the properties located in?
  4. Are all the legal heirs currently outside the UAE or are some residing here?
  5. Did he leave any bank accounts, investments, or other assets in addition to the properties and employment benefits?

Based on the information you shared, it is not always necessary to start with a succession certificate from the home country. Where the deceased owned assets in the UAE, it is often more appropriate to commence the estate procedures in the UAE so that the local assets, liabilities, employment benefits, mortgages, and property transfers can be dealt with efficiently. The correct approach depends on the applicable succession law and the deceased’s personal status.

I have successfully handled a number of cross-border inheritance and estate administration matters involving UAE assets. I can assist by reviewing the estate structure, determining the most efficient jurisdiction to start the process, obtaining the required succession orders, coordinating with the courts and authorities, and completing the transfer of assets to the legal heirs.

I currently have competitive offers available. Feel free to send me the details requested above, and I will advise you on the most practical and legally efficient course of action. My primary intention is to help and provide a legal solution that suits your financial situation.

The safest route is to begin in the UAE, before the court of the deceased’s last residence or where the UAE assets are located.

Obtain the UAE death certificate, determination of heirs, then open an estate file to inventory assets and liabilities. Dubai Courts accepts estate applications, and Dubai property transfers require a UAE inheritance certificate and court letter.

Notify the mortgage bank, property developer, employer and vehicle lessor. End-of-service benefits form part of the estate; debts and mortgage obligations are addressed before distribution.

A home-country succession certificate is mainly relevant to foreign assets or if requested by the UAE court; foreign documents require authentication and certified Arabic translation.

The heirs’ shares depend on nationality, religion, any will and the applicable legal regime.

Hello,

As the deceased passed away in the UAE and the assets and liabilities are primarily located in the UAE, it is generally advisable to commence the succession proceedings before the competent UAE court.

The UAE court can issue the necessary inheritance orders, appoint an estate representative where required, and facilitate dealings with local authorities, banks, the employer, the Land Department, the vehicle leasing company, and other relevant entities.

The estate should first be identified comprehensively, including all assets and liabilities, such as:

  • The mortgaged property;
  • The off-plan property;
  • End-of-service benefits and any outstanding employment entitlements;
  • Bank accounts, if any;
  • The leased vehicle and any remaining contractual obligations;
  • Any outstanding debts or financial liabilities.

It is also important to notify the employer, the relevant bank (if applicable), the developer of the off-plan property, the mortgage lender, and other concerned institutions of the death so that appropriate measures can be taken.

Whether a succession certificate or inheritance order issued in the deceased's home country can be recognized in the UAE depends on several factors, including the country of issuance, applicable treaties, UAE conflict-of-law rules, and compliance with the UAE's legal requirements for legalization and recognition of foreign judicial documents.

Consequently, obtaining a succession certificate in the home country is not necessarily a prerequisite before commencing proceedings in the UAE. In many cases, initiating the inheritance proceedings directly before the UAE courts is the more practical and efficient approach where the estate is principally situated in the UAE.

Given the existence of real estate, employment benefits, financing arrangements, and potential creditor claims, the family should obtain legal advice at an early stage to ensure that all procedural requirements are properly addressed and the estate is administered efficiently.

This statement is considered an initial non-binding legal consultation based on the information and data available.

Should you have any further inquiries, please do not hesitate to share them with us.

As the law firm handling this case, the best and fastest course of action is to initiate the proceedings for the Declaration of Heirs (Certificate of Heirship) directly within the UAE rather than in the deceased's home country.

Since the entirety of the deceased's estate, including real estate, vehicles, and end-of-service benefits, is located within the UAE, initiating proceedings locally saves time otherwise spent on document attestation and translation, and provides you with a document that is directly enforceable before banks, government departments, and real estate companies.

Dear Sir,

I hope this message finds you well.

Yes, we can assist you with this matter and support you in taking the necessary legal steps.

To address the settlement of your late brother-in-law's estate, the steps will be different for Muslim or non-Muslim and whether he executed a registered UAE Will, as this establishes the applicable succession law.

Because the primary assets - including mortgaged and off-plan properties, End of Service Benefits (EOSB), and vehicle contracts - are located in the UAE, you should initiate succession proceedings directly before the competent UAE court to obtain a Succession Certificate, which local authorities, banks, and the Dubai Land Department require to transfer assets.

Before any inheritance is distributed to legal heirs, all estate liabilities (such as clearing mortgages or vehicle loans, ideally via any applicable credit life insurance policies) must be settled first.

We recommend immediately providing the official Death Certificate to his employer, banks, developer, and lenders to freeze and preserve the estate assets while our legal team can prepare the succession filing .

Kindly contact me directly to discuss this matter in detail, either by phone or by visiting my office.
