I want to follow them and take my children back, but he says his local Emirati connections will file criminal cases against me and have me jailed if I go there. What can I do remotely? Does the UAE return kidnapped children to their mother? In the UAE, a guardian cannot legally kidnap their own child; what does this mean for my case? If I report him, what happens to my children? Will they be held until I arrive to take them?

Hello, My landlord vacated the property with 12 months' notice, stating he would live there himself. However, he started renting the property through the holiday homes system. Is a permit issued by the DTC for a holiday home valid proof to prove that he is renting and to claim compensation?

On Jan 2, 2025, one of my close friends did a privacy breach and recorded me and my van in some specific place. On Feb 5, when I called and asked him why he did this to me, he went and gave a complaint that I scolded him and threatened him. The same case was later closed by the PP when we negotiated outside the station and apologized. At this juncture, can I file a privacy breach case against him, which happened on Jan 2, 2025, and on Feb 5 I scolded him only for the privacy breach that happened on Jan 2?

السلام عليكم، أبرمت عقد إيجار موثق في أبوظبي مع مستأجر أصلي في شهر ٢/٢٠٢٢ ومنحته وكالة خاصة في العقار بالإدارة والإشراف والتأجير وقبض الإيجارات وكتابة العقود، كما يحق له توكيل الغير ورفع الشكاوى ضد المستأجرين في المحاكم. شيك الدفعة الثانية عن شهر ٧/٢٠٢٢ ارتد ورجع من البنك لعدم كفاية الرصيد. رفعت عليه شكوى بإخلاء العقار لعدم السداد وخلال أيام سيصدر الحكم بالإخلاء ودفع المستحقات والمصاريف والرسوم. المشكلة أن المستأجر الأصلي تنازل عن المنفعة والاستفادة في شهر ٣/٢٠٢٢ لمستأجر آخر بدون علمي وبدون رضاي حيث قبض المستأجر الأصلي من المستأجر الجديد ثمن تنازله عن المنفعة وسافر ولم يرجع أبدًا منذ شهر ٣/٢٠٢٢ إلى الآن، والذي يدير ويقبض ويؤجِّر للأخرين هو المستأجر الجديد باسم المستأجر الأصلي الذي منح المستأجر الجديد وكالة عامة على ضوء وكالتي. العقود الآن بيني وبين الأصلي وليست بيني وبين الآخر، وتوجد محادثات يقول أنه شخصيًا سوف يدفع لي ويتحمل ذلك ويجب أن أمهله، ومكتوب في الوكالة بند يقول فيه: "يسدد الوكيل على الموكل أي مستحقات أو شيكات باسمه وتحمل توقيعه". هل أستطيع مقاضاة الآخر بناءً على كل ما ذكرت لكم؟

السلام عليكم، استلمت ثلاثة شيكات بقيمة ٢١٢ ألف درهم من شركة ذات شخص واحد في إمارة رأس الخيمة عام ٢٠١٨ وعند الصرف تبين أن الحساب مغلق قبل سنة ولا يوجد رصيد. ذهبت بالشيكات جميعها للشرطة وتم سجن المتهم شهر واحد فقط والآن أمامي فقط الشق المدني. هل أستطيع الآن التقدُّم بالشق المدني؟ وهل سيرجع لي حقي؟ علمًا بأنها شركة ذات شخص واحد ورأس مالها عشرة آلاف درهم فقط، وصاحب الشركة مقيم عربي وغير مبالي وغير مهتم بالسداد، وهو الآن يمارس عمله بشكل طبيعي. ما الحل الأمثل الآن لأن رسوم المحكمة في رأس الخيمة تطلب ١٠٪؜ من قيمة المبلغ وأخاف أن أخسر أكثر مما خسرته معه وبدون فائدة تُرجَى ولا أعرف ماذا أفعل؟ أرشدوني أناشدكم بالله، علمًا بأنني تقدمت بطلب تأجيل الرسوم وتم الرفض مرتين!
