هل يمكن تغريم موظف لاستقالته خلال فترة الاختبار؟

مرحبًا،

أعمل بشركة في منطقة حرة بدبي منذ ثلاثة أشهر بعقد غير محدد المدة وفترة اختبار تمتد لستة أشهر. والآن لا أشعر بالارتياح للعمل مع صاحب العمل وأريد أن أعود إلى بلدي.

لذلك قمت بتقديم استقالتي منذ عشرة أيام. لم يتم إصدار تأشيرة لي بعد وجواز سفري بحوزة الشركة. لكن الشركة ترفض استقالتي وتطالبني بدفع 30.000 درهم دون توضيح السبب.

هل تسمح قوانين العمل بالمناطق الحرة للشركات بتغريم الموظف الذي يستقيل خلال فترة الاختبار؟ ومتى يمكنني استعادة جواز سفري من الشركة؟

During your probation period, it is your right to resign from your position at any time without a notice period.

The employer is not entitled to any compensation by the employee or to withholding your passport. It is also his obligation to follow up on the cancellation of your visa even if it is still under process.

I would advise to get in touch with the labor department of the relevant free zone and bring your case to their attention. They are normally quite supportive and know what to do.
