Q: I own an apartment in Dubai and on the Title Deed I have my name and that of my daughter who is a minor. I have approached a bank for an equity release against the apt and the bank has asked me to get a court permission allowing me to get the loan since there is a minor. I have approached the personal status court and the judge asked me to prepare a personal statement of my position, etc and to include the reason why I need the money and what I plan to do with the money. On the personal statement I put “The purpose that I am applying for this loan is because I would like to use the money towards the continued education of my daughter as she attends university in the United States to obtain a Bachelor’s degree which takes 4 years and part of the application process is to show proof of funds in order to pay for university as a pre-requisite in the application process.” My question is my reasoning ok for the Personal Status Court or should I put something else on my personal statement?

Q: Dear sir/madam, I purchased a villa along with my business partner. The title deed says that we are equal partners in that villa. Later on, the partner signed an affidavit (not notarized) stating that his share of the villa was actually a loan from me, and he would return his share of the villa and also pay 5% interest from the date of the title deed whenever I ask for it. Now, I want my partner to give me his share of the villa but he refuses. So I sent a legal notice. The notice period has expired. Q1. Can I file a performance order AMR AL ADA for this issue since the debt is unconditionally confirmed in writing (or is a performance order only possible for commercial contracts and money, not possible for a property)? Q2. If it's possible to have a performance order case, can I also ask for the agreed interest from the date that I purchased the villa?

Q: I have paid 20% of a commercial property value which has been completed. I am unable to arrange for the remaining amount and want to cancel the contract. Can the builder legally demand 20% more to forfeit a total of 40% before the cancellation? Can the builder put a criminal case for the non-payment of a bank loan? What are my options?

The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.
