Can the real estate agent refuse to sell the property except through a bank loan?
Hello,
I paid a deposit for a completed apartment presented by an agent.
After I paid the deposit, the agent told me that it must be paid only with a bank loan. Somehow, I was forced to take a loan. But in this reservation form, there is nothing about how it will be paid.
I refused and asked for a return, the agent tells me that it is not possible. I sent an email to the company and I filled out a form request for a refund.
Since then, I am waiting. I need help.
Good morning,
Sorry to hear that as this is usual for agents who try very hard to gather money from the clients for no reason.
First of all, the agent has no legal right to seize the deposit amount due to the fact that once he failed to follow the instruction of the reservation form, you have the absolute legal right to claim your money back.
Second, nothing in the law can force you to take a loan to pay your obligations. You already paid them the money that has been mentioned in the reservation form, so they have no right to ask you to get a loan to pay this money.
Based on our history with such cases similar to you, they are acting like that to get a commission from the bank and then put you in trouble with the loan amount.
Please feel free to provide us with a copy of the reservation form, and any other related documents by email so that we can review it and let you know what will the next legal steps be.
Thanks.
