The tenant refused the rent increase. How to evict him?

Hello,

The tenant of my unit in Creek Harbour refused to accept the rent increase because I informed him 85 days before the end of the contract, not 90 days. Can I appeal in RDC or not?

His rent is quite low and I am looking to take him out. Can I do this by anyhow at the end of his contract?

And if no and it has to be 12 months' notice, then I apply for the "want to sell" reason. Can I rent it after that or do I have to sell it only?

Hi,

Pursuant to your query and as per the Dubai Real Estate Legislation for any rental increase or change in terms of the tenancy contract, you need to inform the tenant at least 90 days prior to the expiry of the tenancy contract.

If the same is not done, the tenancy contract will be renewed at the existing terms and conditions.

If you want to sell the apartment, you need to provide a 12months notary notice informing the tenant that he needs to vacate it as you need to sell it.

As per law, if you are providing notice for selling, then you can not rent it. If the tenant comes to know that you are not selling it, he might complain in the RDC.

What if it is not sold for some time and I want to rent it again, can I?

If I need to offer to re-rent, can I offer them a higher price after some time if the unit is not sold?
