س: لدي حكم استئناف عمالي منذ ٥ أشهر ولا تزال الشركة لا تدفع وتتعلل بالإفلاس، ورغم ذلك تجدد الرخصة التجارية وتتلاعب باستلام أموالها لدى الغير عن طريق حسابات وسيطة. أخيرًا طلبت من العملاء التعاقُد مع شركة من طرفها لتقوم بمهامها واستلام الأموال ليبدو الأمر قانونيًا. تم تقديم طلب ضبط وإحضار لأحد الشريكين "المدير المسئول"، ولكن المحكمة استبدلت الطلب بالحجز على الأموال والممتلكات التي لم تعد موجودة. مع العلم أن أول حكم للتنفيذ كان حجز الأموال والممتلكات! هل يمكن تقديم طلب بالحجز على أموال المدير الشريك؟

Q: I am seeking compensation for damages from a company that used my name in fraud. I have finished the case until the appeal court and the execution court has ordered that the company assets and accounts be attached until they pay the sum required as per the judgement. The company has been closed since last year and has no more money left in the bank. If there are no more assets of the company I could go after since the company no longer exists, how else can I get justice aside from the words written on a few sheets of my case judgement paper? I've spent a lot and exerted a lot of effort seeking justice for myself, and when it is time to collect what the judge has determined what I should have, apparently there is nothing left. س: السلام عليكم، أنا عامل لدي ملف تنفيذي مفتوح. الشركة مدينة بمبلغ يتجاوز 155 مليون درهم ومديرها الشريك هرب للهند (وتقريبًا يشغل أموالنا في الهند حاليًا)، وفيها شريك مواطن و2 مدراء عاديين. قدمت منع سفر رُفض، وقدمت ضبط وإحضار 4 مرات وأحضرت مستندات أن الشركة تدفع الرواتب حاليًا وتعمل بحسابات بنكية شخصية، القاضي قال: "شركة ذات مسؤولية محدودة لها شخصية قانونية مستقلة عن شخصية المدير المطلوب ضبطه وإحضاره". سألت محامي قال هناك توجيهات عليا بتجنب الضبط والإحضار. إذًا لا منع سفر ولا ضبط ولا أموال؛ كأن القاضي يقول لي تعيش وتشوف غيرها. حصلت على نسخة من رخص تجارية لشركات أخرى الشريك الهارب شريك فيها وفلل تملُّك شخصي. هل يجوز التنفيذ عليها؟ وهل يمكن استدعاء الشريك المواطن للسؤال؟
