هل من الممكن الاستفسار عن وجود تعميم على الشخص من خلال خدمة "استفسر" بإدخال الرقم الموحد على موقع دائرة القضاء على الإنترنت، أم أن هذه الخدمة غير فعالة؟

Is there any way to get a temporary entry permit to the UAE after being deported?

Q: Hello Madam,
I am from Kerala, India. I had been deported from the UAE in 2005 because I absconded from my employer and worked outside. Is there any way to get an entry permit to the UAE?
I am working with an oil company that has its office in Dubai and they are supposed to send me to the UAE for some training. In 2018, the company sent me there and I was sent back immediately from the airport.
Please help me with some solution.

Q: I had left the UAE in 2006 after an absconding complaint by the previous employer. They had put a lifetime ban also.
How do I lift that ban now?
What are the procedures?

س: السلام عليكم،
حصلت مشكلة مع كفيلي الذي كنت أعمل لديه سائق خاص. قلت له اعطني رواتبي والغِ إقامتي، قال اصبر خمسة أيام وصبرت ولم أحصل على إجابة. قدمت شكوى في مركز توافق وهناك تفاجأت أنه حرر ضدي بلاغ هروب.
عندما حظرني كفيلي اتهمني بقضية جنائية ولكن الحمد لله أخذت فيها براءة وذهب لمركز توافق. استأنفت الشكوى ولم يتم الصلح. أرسلونا للمحكمة وبعد عدة جلسات تم الصلح على إلزام الكفيل بدفع رواتب ثلاثة أشهر وإلزامه بإلغاء الإقامة والحكم يصدر بعد أسبوع.
عند خروجي من المحكمة تفاجأت برجال الجوازات يقبضون عليّ. ذهبنا لمركز المخالفين قالوا لازم أن نرحلك فعليك تعميم هروب، فقلت أعلم ذلك ولكن لدي قضية عمالية يصدر الحكم فيها بعد أسبوع والقانون لا يسمح أن يرحلوني وعندي قضية عمالية.
كفيلي كان معهم وهددوني بالسجن إن لم أوفق وتم سجني أربعة أيام وبعدها ذهبنا للمطار وأعطوني رواتبي مع خصم مبلغ التذكرة من رواتبي ورحلوني.
الحين مضت سنتان ونصف. هل أستطيع الرجوع أم هو حرمان دائم؟ وهل أستطيع تقديم شكوى أو استرحام لدى السفارة الإماراتية في بلدي؟

إمكانية العودة إلى الإمارات بعد مغادرتها بسبب تأخير دفع الراتب

س: السلام عليكم،
أتيت إلى الإمارات بعقد بمرتب وبعد أول شهر عمل لم يتم الوفاء بالعقد ولم يتم تحويل الراتب رغم فتح حساب بنكي لإيداع الراتب وفوجئت برغبة صاحب العمل في تخفيض المرتب المذكور في العقد.
تركت الإمارات وسافرت إلى الموطن. بعد المغادرة علمت أن صاحب العمل رفع بلاغ هروب بعد سفري من الإمارات وأنا الآن خارج الإمارات.
حررت شكوى وذكرت بها كل التفاصيل.
السؤال:
هل يحق لصاحب العمل تقديم بلاغ هروب وأنا خارح دولة الإمارات؟
وهل له الحق في ذلك بعد عدم تنفيذه لبنود العقد؟
وما مستقبل الشكوى المقدمة مني؟
إقامتي لا تزال سارية وأنا الآن خارج الإمارات منذ ٤ أشهر وباقي شهرين من مدة الستة أشهر خارج الدولة. أريد العودة إلى الإمارات. هل سيتم القبض عليّ في المطار؟ وهل التأشيرة أُلغيت؟

According to Article 15 of Cabinet Resolution No. 1 of 2022 (“Executive Regulations”), employees occupying supervisory roles are exempt from the provisions of the Labour Law and the Executive Regulations in relation to maximum working hours only if they possess powers equivalent to those of the employer.
Could you please clarify what is meant by "if they possess powers equivalent to those of the employer"?
Currently, we have heads of departments who report to the directors. Will they be eligible for overtime?
Also, those who have a POA to sign contracts will they be eligible?
Or, those who temporarily replace the CEO while he is out, will they be eligible?
