Q: Hello Sir,
I was staying in an apartment with a friend in Sharjah and I relocated to Dubai before the end of the tenancy. The tenancy contract was in my name.
I wrote an agreement with my friend to transfer the contract to his name or cancel at the expiration.
When the contract ended he could not transfer and refused to cancel, so he started paying by cash to the real estate and owed them a huge amount and they opened a case against me at the municipality.
I went with him and he sent a request letter to the Judge to transfer the debt to him stating that the debt belongs to him but it was not approved.
Now, I have started paying the debt, can I use that his request and our agreement to open a case against him at the police or at the court?

Sub-letting premises and non payment to landlord

Q: I was living in a sharing accommodation not having any link with the main owner. There is a 3rd person who took from the main owner and rent to 4-5 people. We were paying that person timely.
But maybe he did not pay to the main owner, and suddenly main owner representative came and give all 4-5 people notice to pay 8 months' due rent, which we already paid to that agent in cash.
We told him we don't know you and neither we have any agreement better to catch that 3rd person whom you have an agreement with. One day, the owner came to the flat and took out Emirates ID copy.
Anyhow, we vacated the room already and now he is calling on the phone and asking us to pay electricity bills. We told him we already paid to the 3rd person. He said he will take legal action.
Kindly advise what can happen. We paid all the rent which is including everything. We are salaried persons and we are afraid.

Wrongfully accused and fined for subleasing a residential property

Q: My husband and I are living in Wasl properties. One day when the inspection was carried out, our cousin was there at home.
The Wasl guy took his ID and fined us AED 8000.00 for subleasing. Actually, the cousin is staying in a nearby bachelor accommodation but when we told them that, they asked us to prove the relationship in a week's time.
Please advise, how to get rid of the fine as we are not subleasing?

المستأجر الأصلي لعقار تنازل عن المنفعة بدون علم المالك. ماذا يفعل المالك؟

س: السلام عليكم،
أبرمت عقد إيجار موثق في أبوظبي مع مستأجر أصلي في شهر ٢/٢٠٢٢ ومنحته وكالة خاصة في العقار بالإدارة والإشراف والتأجير وقبض الإيجارات وكتابة العقود، كما يحق له توكيل الغير ورفع الشكاوى ضد المستأجرين في المحاكم.
شيك الدفعة الثانية عن شهر ٧/٢٠٢٢ ارتد ورجع من البنك لعدم كفاية الرصيد. رفعت عليه شكوى بإخلاء العقار لعدم السداد وخلال أيام سيصدر الحكم بالإخلاء ودفع المستحقات والمصاريف والرسوم.
المشكلة أن المستأجر الأصلي تنازل عن المنفعة والاستفادة في شهر ٣/٢٠٢٢ لمستأجر آخر بدون علمي وبدون رضاي حيث قبض المستأجر الأصلي من المستأجر الجديد ثمن تنازله عن المنفعة وسافر ولم يرجع أبدًا منذ شهر ٣/٢٠٢٢ إلى الآن، والذي يدير ويقبض ويؤجِّر للأخرين هو المستأجر الجديد باسم المستأجر الأصلي الذي منح المستأجر الجديد وكالة عامة على ضوء وكالتي.
العقود الآن بيني وبين الأصلي وليست بيني وبين الآخر، وتوجد محادثات يقول أنه شخصيًا سوف يدفع لي ويتحمل ذلك ويجب أن أمهله، ومكتوب في الوكالة بند يقول فيه: "يسدد الوكيل على الموكل أي مستحقات أو شيكات باسمه وتحمل توقيعه".
هل أستطيع مقاضاة الآخر بناءً على كل ما ذكرت لكم؟

Canceling my MoU and getting my deposit back due to a low bank valuation and overpriced property 0
Hi,
I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building.
The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024.
One of the articles in the MoU states:
In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates.
I need help urgently.

Can the new owner of an apartment increase my rent if it is against RERA Index? 0

I'm a tenant of an apartment and a new owner has purchased the apartment. I would like to know:
1. Should I revise the Ejari by canceling the previous one and applying for a new one?
2. My current rent is 35% less than the current market value. Can the new owner change the rent as per the market value, or he still has to follow the RERA Index calculator for a new contract?

I agreed with my landlord to increase the rent 10% I pay in cash. Should I insist on changing the contract? 0
I'm staying in JLT in a house with a rent of AED 140,000 per year. The lease starts on 1st Sep '23 and expires on 31st Aug '24.
The landlord sent me a legal notice from the Dubai Courts in mid-Sep '23, giving me 1-year notice to vacate the house as he plans to sell the house. The notice was received by me through email from the court.
He claims the email notice sent by the court is not valid till I receive it by courier via Aramex for my physical signature. Can you please confirm if this is true?
The landlord is now ready to let me stay in this house for two more years. He has proposed that we maintain the existing lease agreement and Ejari. However, I should pay him AED 14,000 in cash (10% increment).
We will sign a separate paper document wherein we will agree that I will further rent increase of 10% (10% on (140,000+14,000)) on 1st Sep'24 when my current lease expires.
Should I insist on making a fresh written contract with the higher rent (140,000+14,000=154,000)?

I have signed Form F and got the mortgage but the seller is in breach. What to do? 0
Hi
I have signed the MOU Form F since July 2023 and we prepared all the papers and the loan from my end on 23/8/2023.
When I went to DLD for the transfer, the seller had registration issues and asked for some papers to be provided as the property is under the company not an individual.
Since that time, we have kept renewing the MOU every month in the hope of finalizing but I am not seeing any progress.
So I am asking about legal action as I already got a bank mortgage and started paying as well but not seeing any progress from the seller.
So I need to ask the following:
1. If my MOU expired on 20.11.2023, can I file a complaint on 20 or after a couple of days like 23?
2. What will happen in terms of 10%? Will it be returned and what about the fees paid to the bank like mortgage fees, evaluation, and cancellation of loan? Will the EMI payment be compensated by the seller?
3. What is your advice?
