Q: Hi,
I have a dispute with one immigration consultancy firm in Dubai. I have signed an agreement with them for seeking their services two years ago.
However, later I came to know that they have not provided complete information for qualification on the first instance due to which my case does not qualify at all for Canadian immigration.
Now, I am asking for cancellation of the agreement, which they refuse claiming it was my mistake.
Kindly advise regarding the right forum and the way to proceed legally with my case.

Claiming money back from a consultant company for delaying the requested service

Q: I have submitted my immigration documents to a consultant company in Dubai under a business formation plan in Canada. They committed that the process for stage 2 will take 2 months but since then it has been 6 months, they have not yet processed it.
They keep making false promises and they would not let us withdraw our case. I Have asked several times to connect me with the higher authorities to resolve my issue but no cooperation from their end.
It is devasting as it is an expensive plan. We have paid 43650 DHS so far. I need to know if legally I can claim all my money back by putting up a fraud case on them under the criminal act?
How can I make them fulfill their commitment without me bearing any loss?
Please guide me with possible ways!

We are an oil services company registered outside the UAE, dealing with a UAE-based company that keeps postponing the shipment of our order.
As a result, we bear penalties due to the delay per day as per our contract with our client. Is there a possibility to file a lawsuit against the UAE-based company?
Is there a government agency that resolves business disputes between local and international businesses before resorting to litigation?

I hired a contractor for works in my villa and failed in performing obligations. What can I do?

Q: Hi,
I got an approved contractor in my villa for bathroom and kitchen work but he really failed to bring what he promised. The finishing is really really bad.
Parts of the ceiling are falling down every few days. The kitchen is in a very bad shape, they used silicon to attach tiles instead of glue.
Some doors fell off after a few times using, and some doors can’t even be opened because another door is blocking their way.
The toilets are a total mess, some tiles are broken, the door frame got destroyed with the work so they took some glue and painted above, the bathroom tub is not fixed and can be moved.
They closed one part of the walls with a tile without removing the window, they installed a fake wall in front but forgot to close the window, so the window is open from the outside but can’t be closed because of the new wall. These, are just a few, really few things.
In the contract we agreed that he would finish the work by the 19th of December, any delay causes an AED 1000 fine a day.

What do we do if we received a legal notice from a client for delay in delivering services?

Q: Dear Respected Adviser,
We are a software development company in Dubai. Today we got a legal notice from a client for not delivering his project at the time mentioned in the project agreement.
Although we have followed everything as per the agreement and he made payment after finding everything worked fine in the Demo presentation meeting.
What should be our approach to this issue?
I am expecting some advice who have experience in dealing with legal cases like Software Development, Mobile app development, or any other development service.

I gave a brand expensive watch to agent for service and they changed delivery and fees. What can I do?

Q: Dear.
I gave a brand and expensive watch to an agent for service. Only 'normal service' at the beginning of 2024. They gave me an estimate and completion time and on this basis, I agreed.
Later, they changed the price for service and time for completion many times without my agreement, I told them this was not acceptable because I already agreed and given my watch.
Until now, my watch is not done and they have not replied to me with an update or anything. I have already reported this to consumer protection in Dubai.
They already spoke to them but no use and told me I could try legal action if I wanted. I am confused and cannot believe a famous shop can do this with a business license and take valuables like this.
Kindly give me an idea of what I can do. I have all communications in email and sms.

Good afternoon!
My friend works as a cleaner for a cleaning company and she now wants to resign with a 30-day notice. However, she has not completed the two-year contract and has only served for 16 months.
Additionally, she has not taken any vacation leave. The sad part is that when she signed the offer letter, she did not receive a copy of it and only signed it.
I would be very grateful if you could let me know if she would have to pay or if her boss has the right to not accept the resignation if the notice period mentioned in the offer letter is more than a month.
Her boss has not provided her with any kind of proof that she can use in the future if anything happens.

السلام عليكم،
هل يحق للبنك في إمارة دبي أن يرفع دعوى جنائية أو مدنية ضد عميل لم يسدد مبالغ الفائدة بل سدد فقط المبالغ التي قدمها البنك أصليًا (مبلغ القرض فقط)؟
منحه البنك بطاقة ائتمانية بحجة أنه "قرض حسن بدون فوائد"، وبعدما استخدم العميل البطاقة الائتمانية بفترة زمنية قصيرة وفجأةً تم إرسال رسالة إلى العميل تفيد بأن هناك مبالغ متراكمة بسبب الفائدة البنكية بقيمة ٤٠٪ من القرض الأساس المُقدم إليه.
علمًا بأنه تم تزويد العميل بالبطاقة الائتمانية عن طريق البريد السريع لعنوان منزله بدون طلب رسمي من العميل بذلك، بالإضافة إلى أنه لا يوجد أي من المستندات التالية بين البنك والعميل:
١- عقد. ٢- اتفاقية. ٣- شيكات كضمان. ٤- سند أو شريعة أو قبول خطي أو غير خطي أو توثيق يتضمن أي توقيع من الأطراف؛ بمعنى آخر، لا يوجد أي اتفاق على الإطلاق.
العميل سدد المبالغ التي استخدمها ورفض دفع مبالغ الفائدة البنكية المضافة سالفة الذكر.
