Obtaining an employment visa while case is pending
Dear Ma'am,
Good day,
I have opened a labour case due to 6-month pending salary & salary deductions for 3 years (2014-15-16). The matter is in court & I am awaiting court dates for the case.
My query is regarding getting new employment visa (not 6 months' temporary work permit) during ongoing court case (heard that due to amendment 766 of the year 2016, this is possible).
I have a new offer at hand, can I request from the court/MOHRE to cancel my visa & issue a new employment visa?
The total claim amount is AED 194K, what are the points should I keep in my mind while the case is ongoing?
Should I hire employment lawyer?

If you cancel your visa, you have no labour relation with the company and thus no entitlements and your claim/current case will lapse. A temporary work permit is the only choice.
Please make an application to grant you the relevant permission.
STEP 1 - Request from the court to provide you with a certificate stating that you have a labour case pending before the court,
STEP 2 - Please apply to the Ministry of Labour to grant you permission to work temporarily for six months. Attach the Court certificate with the application related to the temporary work permit before the Ministry of Labour.
This may grant you the temporary work permit.
