How to cancel the visa to get a job offer while labor dues are pending?
Hello Sir,
I have been working in a company for 17 years and lost my job in July 2021. My visa is till Dec 2021. Till now, I have not received my settlement. I am getting only promises that it will be settled shortly. I haven't canceled my visa yet.
Last four months, I am somehow surviving with my family. Last week, I have got a job offer, but if I cancel my visa in my previous company, I am signing that I have received all my dues.
Please advise, what can be done?
a) Even if I sign that I have received my dues, and cancel my visa, can I legally claim my settlement?
b) If I don't cancel my visa before by expiry of the visa, what happens?
c) My family visa is on me and their visa is till June 2022. Will it affect them?
d) If I have to travel to India for an emergency, can I come back?

Dear questioner,
You should negotiate with your previous employer to get a cheque with your settlement and then cancel your visa.
If your employer refuses, you should immediately start a complaint in MOHRE and then raise a case against your employer.
At the same time, you can request the judge to allow you a temporary work permit to work with the new employer that sent you a job offer.
