Enforcement of non-competition clause in labour contract
I have signed a labour contract with the non-competing clause for 12 months. I would like to know, how this can be enforced if I join another company whose activities are not exactly the same but are similar.
I'm working for a manufacturing company and would like to join the trading company, which is my former employer.
My current employer is not comfortable with me going back to my former employer and is asking me to refrain from this based on the clause in my contract.

Dear Kumar,
I hope you are doing well, with regard to your question related to competition clause, I would like to clarify that in accordance with UAE Labour Law and the application of such law in the courts, in order to consider that the Employee has violated the competition clause, the agreement must be confined in terms of time, place and the nature of the business.
So as long as you said that the business is different in its nature so you do not need to worry about working with your previous employer.
