كيف يمكن متابعة قضية تنفيذ ضد شركة بعد وفاة الأخ؟

نحن هندوس. توفى أخي مؤخرًا في دولة الإمارات.

أ) سجل أخي قضية تنفيذ مدنية في محاكم دبي.

لقد قدمت طلب لاستخراج شهادة حصر الإرث. هل يكفي أن أسجل اسمي في محكمة التنفيذ بصفتي الشخص الذي سيقدم كافة العرائض ويحصّل أي مدفوعات يقوم بسدادها المّدين؟

أم يجب عليّ الإشارة إلى القضية القائمة لاستخراج شهادة حصر الإرث؟

ب) أصدرت الشركة إقرارًا بالديون المستحقة لأخي، لكنهم يرفضون الدفع.

ما هي الخطوات التي يجب عليّ اتخاذها في محكمة الأسرة بخصوص الميراث حتى أتمكن لاحقًا من رفع قضية تجارية لتحصيل الديون المستحقة لأخي المتوفى من الشركة؟

هل يجب عليّ الحصول على خطاب من محكمة الأسرة يسمح لي برفع قضية تجارية نيابةً عن أخي المتوفى؟

Dear questioner,

Note that you would first require an heirship certificate and we assume you already applied in the personal status courts. After that, all the heirs mentioned in the certificate must provide you with the power of attorneys, and only then you can represent your deceased brother in the civil execution case.

No, you cannot add this execution case to the inheritance case you made; they are two different areas. Once you receive all the POAs, you will be able to make a case against the indebted company too.

As per your query, please note that once you take the succession certificate from the court, then you need to provide a POA from the existing successor (if any).

Otherwise, as per the certificate, you can appoint a lawyer who can replace the name of your deceased brother with yours by filing the necessary documents.

I am one of the successors of my brother.

Re-existing Execution Case:

I understood from your kind reply that I can approach the Execution Court with the Succession Certificate and POA from other successors, and request the court to add my name instead of my brother for the existing Execution Lawsuit.

New Commercial Case:

I understood for the new commercial case for the company that owes money to my brother, I can register the case and add the succession certificate and POA from other Successors as evidence.

Did I understand that correctly?

Yes, however, other documents are needed too, like the death certificate and other medical documents, translated and attested. It would be good for you if you can appoint a lawyer.
