Q: Hi,
I am going to buy an apartment in Dubai.
If I am going directly from the seller's broker, shall we both (seller and buyer) pay 2% each to this broker? And also it asks for a convenience fee of 5000 Dhs, what is it?

Refund of an off-plan apartment payments for delay in handover

Q: I bought an off-plan apartment a long time ago and paid almost 80% of the property value per my contract. Unfortunately, the developer couldn't manage to deliver it on time and transferred it to another developer 4 years ago.
The apartment is not ready by the second developer yet and they say that it might be ready by 2024 (Per our contract it should have been completed by 2009).
I called the second company and asked them to terminate my contract but they told me that they are not responsible for it and I need to contact the first company.
I also sent a couple of emails to this company (the second one) but they didn't reply to my email.
How can I get my money back?
What is the legal process in the UAE for such a case?

Commission payable to property agent dismissed before the deal was closed

Q: I was working for a real estate company in Dubai. I was part of a big deal for selling a villa for 18.5M. The deal was signed while I was with the company, and I was still in the company a few months later until the owner terminated me under the reason “services no longer required”.
The MOU was signed while I was with the company and the deal was meant to go through in September, I got terminated in August.
I have a voice recording of the whole conversation on the day I was terminated in which the owner clearly states I was part of the deal and as I'm no longer part of the company he will need to consult with his partner whether I'm owed my commision.
I have spoken to the buyer who has confirmed that the deal has gone through and they are the new owners of the villa.
I have contacted the owner of the real estate company who is reading my messages and ignoring me.
I am owed 50k commision.

Q: Hi,
I have a concern. We have signed a contract with a seller, but it's not an F contract. We signed an MOU, which is an A contract, and the seller has signed the same, which is a B (this comes from the real estate agency).
The seller has specified the date of transfer and confirmed his availability to the agent, but the agent didn't inform us as a buyer.
The seller raised a complaint in RERA mentioning that the buyer didn't show up to sign the NOC, knowing we, as a buyer, had sent many emails to the agent as follow-ups.
However, it was ending up with the same answer from the agent that the seller was not answering his calls and he did not confirm the date to sign the NOC.
We went to RERA, and they asked us to solve the issue between us. Now we are waiting for the seller to see if he would like to proceed with the sale.
My question is, as a buyer, how to protect ourselves as we have given a deposit cheque to the agent and paid for the conveyance fees and valuation?
What is the next step from our side?

Is it legal for the real estate agent to keep the commission despite cancellation of the project?

Q: Hi,
I bought a property off-plan last year. The developer went bankrupt and the project was recently cancelled by RERA. We were refunded the deposit we paid.
The estate agent that we used to purchase the place took commission (brokerage fee) of 40 000 dhs. They are now refusing to refund us, even though the project is cancelled.
We never received an SPA or the house. The contract between us and the agency states end date is until transfer, that never happened. Is this legal?

Does the law give the seller of property to request a security cheque from the buyer?

Q: Hi.
I am in the process of buying a property in Dubai.
The real estate broker is insisting on a security cheque issued in the name of the seller which is to be kept by the broker until the day of title deed transfer and to be returned back on the same day.
I understand this is "standard practice" but is it a law?

I have two questions:

(b) The second question is, do I have to renew the rental agreement for 3 months (until December 2024) or not?

How can I reach a settlement with the bank for a mortgage of a jointly owned property? 0
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage.
As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine.
In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this.
I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property.
I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

How to claim the remaining amounts unpaid by a company after delivery of goods 0
Our company (Ajman Freezone) has delivered goods to a company in Mainland Dubai.
The payment terms agreed on 30% on order confirmation and 70% on delivery of goods to the warehouse in Dubai.
The customer paid 30% on the order confirmation and failed to settle the 70% on delivery of the goods to their warehouse. Upon confronting the customer that he failed to comply with the payment terms, he asked to pay in installments.
We agreed on five monthly installments and the customer confirmed the date and amount of the payments via email.
Oct 2020, November 2020, December 2020, January 2021 and February 2021.
He failed to pay December 2020, January 2021 and February 2021.
Since then he has been avoiding us, and only when we keep pressuring him, he pays small amounts, which are not equal to the monthly installments agreed upon.
The installments were confirmed, but not handed over as PDC.
Kindly advise what can be done in this case and if it is feasible to go to court.

I live in Dubai Marina, and the landlord claimed that according to new Dubai Land regulations, the chiller now has to be paid by the person occupying the apartment.
Even though my contract says that the landlord should pay the chiller, they want to implement this mid-contract.

Good afternoon!
My friend works as a cleaner for a cleaning company and she now wants to resign with a 30-day notice. However, she has not completed the two-year contract and has only served for 16 months.
Additionally, she has not taken any vacation leave. The sad part is that when she signed the offer letter, she did not receive a copy of it and only signed it.
I would be very grateful if you could let me know if she would have to pay or if her boss has the right to not accept the resignation if the notice period mentioned in the offer letter is more than a month.
Her boss has not provided her with any kind of proof that she can use in the future if anything happens.

I represent a tech-based marketplace company registered in a Freezone, in the UAE.
This is in regards to the UAE's law regarding the ownership of code when there is no clause mentioned in the agreement. One of our products (web application) is being developed by an agency in the UAE.
While we do have agreements in place, there is no clause regarding ownership of code. In the situation mentioned above, I've heard that the ownership of code either goes to the author or the agency that employed the author. Is this true?
