س: قمت برفع قضية مضمونها دعوى محاسبة على شركة تمويل كنت قد تحصلت منها علي قرض شخصي وبطاقة ائتمانية منذ أكثر من ثلاثة أعوام. القرض كانت مدته ثلاثة أعوام وبعد مرور عامين قامت الشركه نفسها بعرض مالي علي بسداد باقي القرض والمبالغ المسحوبة من البطاقة الائتمانية عن طريق قرض جديد. لم أكن أتأخر عن السداد يوماً واحداً طيلة هذه الفترة وبعد مرور عام آخر من السداد المتواصل قمت برفع دعوى محاسبة بالمحكمة، والمحكمة حولت القضية لخبير قانوني. لكن عندما وصلت الأوراق الي الخبير كانت الشركة قد وضعت علي العقد قيمة فائدة 39.96% سنويا واعتمد الخبير معدل الفائدة بحجة أنه موجود بالعقد المبرم بيننا. عندما وقعت علي العقد لم يكن هذا الرقم الخيالي من الفوائد موجوداً وتقرير الخبير الآن سيصل للمحكمة في خلال يومين وفيه علي مبلغ مستحق 72000 درهم، مع العلم أن شيك التامين لدي الشركة قيمته 55000 درهم. وعندما تحدثت مع الخبير قال لي طالما أن المحكمه لم تحدد لي سعر الفائدة، فإنني ملتزم بما هو موجود بالعقد. وللعلم فإن الخبير لم يقم بحساب القرضين ولكن بحساب القرض الأخير فقط. هل من حل قانوني، مع العلم أن نسبة الفائدة مكتوبة بخط اليد؟

Q: Hi. I got a loan of 30,000 from a finance company. I was paying my monthly EMI. After that, I lost my job and I wasn't able to pay. Then I got another job. My employer applied for a visa but my name got a match with a guy who is blacklisted in the UAE. After many attempts, I got the visa but I did not get my Emirates ID. Due to expired ID, my sim got blocked and I was not in contact with the finance company. Even to date, I don't have an ID. Before a few months, the finance company put a case on me and I was unaware about that and I have no idea that there is running a case on me. In my absence, the court gave a judgement of 5 months in prison. I'm still in the UAE. A few days ago, I was travelling from Sharjah to Oman and they arrested me at Sharjah airport. I am on bail now. My next date in court will be in next week. I want to know is there any solution to avoid prison or convert prison to fine?

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.
